Why is Mary Odili's name tied to the judgement? Was name of the Judge that headed the panel of Suoreme Court Judges that presided over Imo election saga tagged to that judgement?
I abhor this hypocrisy. sad

They are mischief makers. Shame that a man has 5 names without any affidavit of change of name. Shame .

APC was foolish to have kept quite about the antecedents of Mary Odili. She is from Imo state where APC just overturned. In fact, she is from Mbaise just like Ihedioha so indeed a distant relation of Ihedioha.
She is also married to a powerful PDP member. She fought Pdp battles for them.

The Supreme court has spoken, which should be final, as it is all over the world.

It all depends on who the indigenes of Bayelsa want and not what the Hypocrites that have never stepped their feet on Bayelsa state are shouting about.

For those of us that are not card carrying members of any political party, but only vote for good men and women that we believe can move their immediate environment forward (same reason all of us @ voted for our darling Daddy in the presidential election and voted for another candidate in another party in our state of residence, no apologies ro Sanwo-Olu!)

It is sad that the days intellectuals (from opposing and different political affiliations) discuss politics on the political threads on Nairaland is gone and now it has gone to kids, hypocrites and dirty agberos that curse and abuse their mothers and fathers with no reasonable and sensible posts to contribute)

Lastly......

It is a always good and refreshing to see that we have a President who does not intervene in the rule of law.

Elections In Nigeria now,
There is no need to fear.
Why? Because the will of Nigerians will not be subverted. Never! A President once told us in this country that the coming polls would be do or die.
Not with President Buhari. Fair is fair. No foul play. Under his watch, his political party, the All Progressives Congress (APC) has lost gubernatorial elections in Bayelsa, Oyo State and Anambra states.
At the last Council of States meeting, Gov Willie Obiano publicly registered his appreciation to President Buhari, for the level playing ground he made available during the election in his state. With do or die apostles, and a certain political party in power, such would never happen. Not with their garrison mentality. All states are territories that must be conquered, willy-nilly.

APC has won gubernatorial positions under Buhari in Kogi, Ondo and Edo states. The victories were fair and square. The party lost in Bayelsa, Oyo, Anambra etc.
This President would never manipulate victory for anyone, not even his own party. And you ask us not to trust him?
We will, and no mistake.

God bless our darling Daddy President Muhammadu Buhari.
God bless Nigeria.

Lol cheesy
Just 3 mins ago sir!
All of us @ love you too.....it's Valentine's Day.

SUPREME COURT JUDGMENT ON BAYELSA ELECTION: WHIRLING DUSTS IN THE LEGAL ARENA

The Supreme Court judgment on Bayelsa Governorship election has raised many dusts for legal fireworks which may be difficult to quench permanently even by the Apex Court until the parliament comes into rescue by amending the Constitution and the Electoral Act.

Since the Supreme Court has annulled the election of Bayelsa governor-elect and his Deputy in its judgment, thereby directing INEC to issue Certificate of return to the person who scored the 2nd highest number of lawful votes cast and covered the geographical spread in the State as provided in the Constitution. Then there will be need to consider if PDP meets the Constitutional requirements as provided in Section 179(2(b) ) of the Constitution of the Federal Republic of Nigeria, 1999 (as amended).

In other words, if PDP has the 2nd highest number of lawful votes in the election but failed to have not less than one-quarter (25%) of all the votes cast in each of at least two-thirds of all the local government areas in the State. By implication, the PDP candidate must have at least 25% of lawful votes in at least 5 LGAs out of the 8 LGAs.

See the result of Bayelsa Governorship election and analysis. *(culled)*

1. Ogbia LGA:
APC - 58,016 *80.8%*
PDP - 13,763 *19.2%*

2. Yenagoa LGA:
APC - 24,607 *70.3%*
PDP - 19,184 *29.7%*

3. Brass LGA:
APC - 23,831 *69.6%*
PDP - 10,410 *30.4%*

4. Okuma/Opokuma LGA:
APC - 8,934 *36.7%*
PDP - 15,360 *63.2%*

5. Nembe LGA:
APC - 83,041 *99%*
PDP - 874 *1%*

Sagbama LGA:
APC - 7,831 *11.9%*
PDP - 60,399 *88.5%*

7. Southern Ijaw LGA:
APC - 124,803 *96.2%*
PDP - 4,898 *3.8%*

Now ⅔ of 7 LGAs is 7x ⅔ = 4.7

But from the above results PDP scored 25% in only 4 LGAs. Therefore the PDP governorship candidate cannot be sworn in or be issued Certificate of Return.

Consequently, there will be need for fresh governorship election in Bayelsa State while the Speaker of the State will be sworn in tentatively as Acting Governor of Bayelsa State pending the outcome of the fresh election. This is in accordance with Section 191(2) of the Constitution.

However, if re-run election is to be held, does APC have a right to substitute its deputy governorship candidate having been disqualified by the Court and having regard to Section 33 of the Electoral Act, 2010 which provides thus:
" A political party shall not be allowed to change or substitute its candidate whose name has been submitted pursuant to Section 32 of this Act, except in the case of death or withdrawal by candidate."

Flowing from the above provision, the only instance or situation where substitution is permitted is where the political party's candidate dies as in the case of AUDU/FALEKE or he voluntarily withdraws from contest. In the case of Bayelsa State at hand, the Supreme Court disqualified the APC deputy governorship candidate.

Thus, having been disqualified, can APC deputy governorship candidate hide under that guise, by applying for a withdrawal from contest in order to permit APC to substitute his name with another? This is the point where the dust will be raised for legal debate that may even roll back to the Apex Court for resolution.

Though my humble view to this poser will be in the affirmative. Even though, it is not expressly provided in the Electoral Act, withdrawal of candidate from election may come in any form and no reason need be disclosed to INEC for such withdrawal. This is a situation where doctrine of necessity will be applicable to cover the constitutional lacunae.

Meanwhile, it is imperative for the National Assembly to take a second look at the provision of Section 33 of the Electoral Act for probable amendment and for avoidance of legal conundrum as this.

My humble legal opinion...

This is coming from a neutral person. Should Justice Mary Odili be sitting on such a case considering she was a first lady to a former governor who is a member of one of the two parties she was presiding on? I personally think bias judgement or emotional one won't be inevitable.
Why didn't you say this In the case of 'Tanko in Imo state judgement'? after all Buhari appointed Tanko and we can also use that as a yardstick.
