Thats why a good landlord should do a physical and mental evaluation of a prospective tenant. I cant give some I doubt their sanity my house, even if he wants to pay double.

I owed my landlord for 3 years some years back when my business collapsed. The man was so understanding then and even accomodated my loads from my office when I closed shop.

That was why when same issue came up with a shop here in Lagos, we went to court for 3 years and got judgment before we could open the shop. Learnt the hard way.

So much so. My father's tenant has not paid for more than 2 yrs running now. He was asked to leave and go with the money. He refused to move out. He was taken to court to be evicted and to our greatest surprise this guy had money to hire a lawyer. Hearing is in February 2021

All these kind matter dey vex me. First, your father shouldn't have let it stay that long. Once a tenant defaults a month after due date, get an eviction notice from the Lagos state government, this means the tenant has to leave your house in 6 months time. Me, I won't collect the rent again if the tenant doesn't pay within the first 3 months.


Once the six months has elapsed, you are backed legally and illegally to throw him out. If he want show stubbornness, run am street or go village make you reason him matter. Bro, even if the man na military, I go pursue, I go handle him matter wella. If he feels he can intimidate me, whatever happens, he'll be watching from the heavens.

I've dealt with this kind of situation before so no be mouth. The man was one oga for nigerian prisons.

One even accused me of rape and got me arrested.

Nowadays, I only deal with tenant through companies. If yoy miss your rent, I will go straight to your company.

He feels above every one as he is a uniform officer.

First, you guys probably respected him too much which makes him feel that way. I have friends in the armed forces, and people I don't even talk to much that are also in the force. Everybody dey mind their business, I no dey bow down for them. We dey relate normal.

Secondly, you shouldn't have let it stay this long. Once a tenant defaults for up to 2 months, serve him an eviction notice. This gives him right to legally stay for up to 6 months after which you have the law's backing to throw him out. If he wants to prove stubborn, there's ways I can deal with people like that both directly and indirectly, ajè, dem no born am well.

I've dealt with an oga in the nigerian prisons just last year, 2019, they were threatening with courts and stuff but we settled out of court. The man doesn't tuck in his shirts in the office just to confirm to you that he's one of heir top shots, talkless of one FRSC Officer.

Just make sure you get the eviction notice first, that would give him 6 months grace, no look him face o! No send am, and don't be the only one involved in the fight. If you were my friend and you brought this kind of issue for us to debate, the man to commot that house in less than a year. aje

The appellant’s counter-claim was dismissed. The appellant’s appeal to the Court of Appeal was also dismissed and the appellant appealed further to the Supreme Court.

HELD

Leading judgment by Pius Olayiwola Aderemi, JSC; with A.I. Katsina-Alu, S.A. Akintan, M. Mohammed, W.S.N. Onnoghen, JJSC concurring

1. Substantial error in concurrent findings of lower courts must be corrected on appeal

An Appellate Court can interfere with the concurrent findings of lower courts where there is substantial error on the face of the proceedings which served to occasion a miscarriage of justice. Per Aderemi, JSC at 135.

2. When eviction amounts to trespass

At the time the appellant took over possession of the property, the respondents still had the keys and were therefore still in possession. The appellant therefore ejected the respondents from the property while their motion for an extension was still pending. Considering the circumstances of the case, the appellant committed an act of trespass, since trespass is a wrong against possession. Per Onnoghen, JSC at 153.

3. Landlord not to resort to self-help

A landlord who resorts to self-help to recover property leased by him runs foul of the law and is liable in damages. Per Aderemi, JSC at 135.

4. Liability in damages for trespass

In ejecting the respondent the appellant committed an act of trespass against the respondents and was therefore liable to the respondents in damages. Per Onnoghen, JSC at 153.

5. Commission of a crime must be proved beyond reasonable doubt

If the commission of a crime by a party to a civil case is directly in issue, the party must prove it beyond reasonable doubt. Per Aderemi, JSC at 135.

The quantum of damages had to be proved beyond a reasonable doubt, not on the balance of probabilities normally applied to civil matters. Per Onnoghen, JSC at 153.

6. Special damages must be specifically pleaded

Special damages consist of all items of loss which must be specified in pleadings before they may be proved. Per Aderemi, JSC at 135.

The respondents failed to prove their special damages beyond a reasonable doubt. Per Aderemi, JSC at 135.

The lower courts erred in awarding such damages. Special damages must not only be pleaded by the party claiming same but must also be strictly proved. Per Onnoghen, JSC at 153.

7. Award of special damages must not be outrageous

The award of damages in a case may not be outrageous.
