The current election sequence was done not by INEC but by the NASS so reversing can only be done by NASS period...!!!! The NASS is an institution and not the individual lawmakers occupying the institution. |

The Constitution empowers the NASS to make and amend any section of the Constitution they deem fit to amend. The Electoral Act is a creation of the NASS. Election sequence or not they can amend. Their amendment of the sequence does not guarantee them automatic entry to the NASS. They would have to still participate in general elections after being sponsored by their political parties and primaries. Telling them not to amend is simply playing sentiments and indirectly denying them their constitutional duties...!!! |

The Court of Appeal, Abuja Division has adjourned hearing in a suit challenging the ruling of a Federal High Court which set aside the amendment of the 2010 Electoral Act. A three-man panel of the court led by Justice Abubakar Yahaya told the parties in the case on Thursday that a full court would be constituted to hear the suit, as their panel cannot hear the appeal. The counsel to the National Assembly, Mr Joseph Daudu, said the issue before the court was very urgent. He told the court that suit torched on matters of the coming general elections and as such, time was important. Daudu stressed that urgency was much more intense, as not having a pronouncement could make anyone want to challenge the bill. In his submission, counsel to the Accord Party Wole Olanipekun told the court that there was nothing urgent about the appeal to warrant parties to return to the court when the Appeal Court was headed for its annual vacation. He, therefore, urged the court to adjourn the case till the next legal year. In a short ruling, Justice Yahaha adjourned the case till a date to be communicated to the parties, for a full panel to be constituted. The Federal High Court had ruled in favour of the Accord Party which urged President Muhammadu Buhari not to sign into law the amended Electoral Act Bill 2018. The court held that the National Assembly lacked the powers to decide on the sequence of the election on behalf of the Independent National Electoral Commission (INEC). Since Nigeria returned to democracy, presidential and National Assembly elections have been conducted on the same day before other polls, while the governorship and State Houses of Assembly elections follow. Lawmakers at the National Assembly had in February amended the sequence such that the National Assembly polls would be conducted first, followed by the state lawmakers and the governors while the presidential election should take place last. This led to a heated debate in the Senate after which President Buhari wrote the lawmakers in March, informing them that he had withheld assent to the amendment of the 2010 Electoral Act. The President had stated that the amendment to election sequence in section 25 of the Principal Act might infringe on the constitutionally guaranteed discretion of INEC to organise, undertake and supervise all elections provided in section 16(a) of the constitution. A former Director of Mobilisation at the National Youth Service Corps (NYSC), Mr Anthony Ani, has distanced the scheme from the certificate of exemption allegedly issued to the Minister of Finance, Mrs Kemi Adeosun. Speaking on the matter in a telephone interview on Channels Television’s Sunrise Daily, Ani argued that the NYSC could not have issued the purported certificate in question. “First and foremost, I have to comment based on the documents that I saw,” he said on Wednesday. “If those documents were the documents claimed to have been submitted, I want to emphatically say that no! they wouldn’t have emanated from the NYSC.” The former director stressed that the NYSC Act had clearly highlighted the process of mobilisation for graduates in the scheme. He said section 2 of the law embedded under section 315 of the Nigerian Constitution categorically stated that graduates of higher institutions who have not attained the age of 30 must make themselves available for mobilisation. Ani maintained that it was not for graduates of local and international institutions make excuse but the responsibility of the NYSC to determine those that would be exempted from the scheme. He said, “According to the law, all those who graduated with effect from 1974, who studied abroad or in Nigeria and you are not above 30 years, at the point of graduation, you are supposed to make yourself available for mobilisation and you will be deployed. If you are above 30, you will be exempted.” “The other categories of graduates that will be exempted are those who have served in the Nigerian Police or the military for not less than nine months… even if you graduate at the age of 20 and you are in the U.S. and you have not made yourself available to be mobilised, whenever you come back even if you are 60 years, you have to undergo the NYSC,” the former NYSC director insisted. The national youth service is a compulsory scheme for all Nigerian graduates who have not attained the age of 30. A report which went viral recently had claimed that Mrs Adeosun failed to participate in the service and supposedly obtained a fake exemption certificate. But the NYSC had confirmed in a statement on Monday that the minister applied for an exemption certificate. “Checking our records, Mrs Adeosun did apply for an Exemption Certificate. We shall investigate the origin of the purported exemption certificate in question,” the NYSC said in the statement by its Director of Press and Public Relations, Adeyemi Adenike. The current Minister of Finance; Mrs. Kemi Adeosun's failure or yet to file character defamation suit or libel in Court against Premium Times is an admittance or proof that all allegations against her are true. In Law, when a claim is entered against a defendant, failure to file a counterclaim is adjudged an admittance. If she was innocent, this would have accorded her the opportunity or open cheque to name her price (N5b) against Premium Times and trust the DSS, they would have raided the offices or houses of all editorial boards of the media outlet by now...!!! Hope this helps..!!! For you to have passed out of service in 2009 means you started in 2008 right? By the time you were in your PPA, your state NYSC officials were preparing your discharge Cert. So since its not possible for the DG to sign all cert one by one, they do a mass print of the Cert with his signature on it. In the case of an applicant applying for exemption, the DG would need to approve first. So the NYSC officials would need show the sequence and evidence of the approval |

She graduated at the prescribed age bracket but failed to return for the service. Returning to the NYSC in 2009 to apply for exemption would only be possible through the black market. |

Well meaning Nigerians should Recall how recently when the news of the discovery of the ikoye Cash by the NIA and former SGF were made public, the presidency was forced to immediately suspend the duo to allow for thorough investigation of the allegations and to ascertain the level of tneir invovlement Well, that is what is expected of any decent administration. Kemi Adeosun should either resign or be suspended immediately so those who would investigated the matter including the NYSC management would treat her as an ordinary citizen and not as a Minister of the FRN. The idea of the scheme is to foster unity and to promote service to the Nation and no other than the NYSC management should lead by example in showing patrotisim. For the sake of all of us who at one time or the other were called 'Ajuwire' we don't deserve to be cheated by the very government that swore to abide by the tenets of the constitution. |

Beyond Kemi Adeosun's resignation, the DG of the DSS should also resign for allowing such security breach pass through his scrutiny. All Ministers and appointees of the president before appointment undergoes a vigorous and thorough security checks, how come this one scaled through and heads haven't started rolling? This simply shows that the DSS has been highly politicized and the DG unfit to still retain his seat...!!!
