The National Assembly Election Petition Tribunal sitting in Makurdi on Thursday fixed Aug. 18 for former Senate President, David Mark to testify in person. Senate President, Sen. David Mark Senate President, Sen. David Mark Mark was dragged to the tribunal by his only contender, Daniel Onjeh of the All Progresses Congress (APC) over his declaration by INEC as the winner of the Benue South Senatorial election. Onjeh had argued that the elections were marred by electoral malpractices and substantial breaches of the Electoral Act 2011 as amended. He also averred that INEC officials were compromised and voters were financially induced by the PDP agents at the various polling units in the district. The petitioner, therefore, urged the court to nullify the election and order for fresh poll. Mark’s Counsel, Mr Kenneth Ikonne, had told the tribunal on Thursday that his client would be appearing in person to testify during the next adjourned date to enable him close his case. Ikonne had also called five witnesses who testified that the elections were free and fair. The witnesses denied financial inducement of voters as alleged by petitioner. However, under cross-examination by petitioner’s Counsel, Mr Tunji Oso, one of the witnesses, Mr Abuh Adesi, admitted that card readers were used to accredit voters in his polling unit. Adesi had earlier deposed in his written statement that incident forms were used for accreditation instead of card readers in his polling unit. At the end of the testimonies and cross-examinations, Ikonne prayed for an adjournment, promising to close his case with the testimony of Mark. The tribunal Chairman, Justice Mosumola Dipeolu, adjourned the case to Aug.18, for further defence. - See more at: http://www.vanguardngr.com/2015/08/buhari-sacks-npa-md-reinstates-abdullahi/#sthash.kvxjYibl.dpuf

A Federal High Court in Lagos has struck out a fundamental rights enforcement suit filed by a former Deputy Governor of Ondo State, Alhaji Ali Olanusi, to challenge his impeachment. Justice Mohammed Idris, in a judgment on Thursday, held that Olanusi’s suit was an abuse of court processes, noting that the reliefs being sought were same as those in an earlier suit marked Ak/51/2015 still pending before an Ondo State High Court in Akure. “The issues of the fundamental rights of the applicant were raised in that suit as in this suit. This cannot be allowed. “The institution of the first action between the main parties or even similar parties on same subject matter simultaneously when the previous suit has not been disposed off constitutes an abuse of court processes. “I therefore hold that this suit is filed in abuse of court processes in the light of suit numbered AK/51/2015,” Idris held. The judge also held that he had no jurisdiction to entertain the suit and went on to fault the joining of the Inspector General of Police as a defendant, who, he said, played no role in Olanusi’s impeachment. Idris upheld the submission by the Attorney General of Ondo State, Mr. Eyitayo Jegede (SAN), who represented the first respondent in the suit, that “it is clear that the applicant merely joined the Inspector General of Police as a subterfuge to justify bringing this application before this court in an obvious situation of lack of jurisdiction. “Making the Inspector General of Police as a respondent against all grains cannot salvage the situation.” Idris, however, rejected Jegede’s argument that Olanusi filed his suit in breach of Order X Rule 1 of the fundamental rights enforcement procedure 2009. Olanusi, who was impeached on April 27, 2015, had sued the IG and the chairman of the seven-man investigative panel which found him guilty of impeachable offences, Mr. Olatunji Adeniyan. In his suit, which was transferred from the Akure Division of the Federal High Court to the Lagos Division, so that it could be urgently heard, Olanusi contended that the Adeniyan-led panel breached his fundamental right to fair hearing. His lawyer, Mr. Olukoya Ogungbeje, claimed that “the sitting, conclusion of proceedings and submission of report by the panel within one day” denied Olanusi his right to fair hearing as enshrined in Section 36 of the 1999 Constitution. Olanusi claimed that the impeachment panel did not give him adequate time and facility to defend himself against the allegations of misconduct which he was found guilty of. He also alleged that the Adeniyan-led panel failed to personally serve him with the notice of the allegation of misconduct before proceeding into hearing and reaching its verdict. He therefore sought an order quashing the proceedings and the report of the Adeniyan-led seven-man impeachment panel which recommended him for impeachment. He also sought an order nullifying his removal as the Ondo State Deputy Governor by the state House of Assembly on April 27, 2015. But Adeniyan, through the Attorney General of Ondo State, Jegede, filed a notice of preliminary objection, urging the court to discountenance Olanusi and strike out his suit. Jegede, who described Olanusi’s suit as an abuse of court processes, said the ex-deputy governor goofed by approaching the court through a fundamental right enforcement application to challenge his impeachment http://www.punchng.com/news/court-refuses-to-reinstate-mimikos-sacked-deputy/ |

Its quite funny once the name Rape is being mentioned, 90% of us if not 100 percent takes it to guys only.. Without having a single idea that out here in real life women do rape men too.. Rape is a serious issue and it should be treated and cautioned darely.. I really don't wana share this because it was a horrible experience but, due to some of the posts I saw lately on rape and people tagging it only women experienced that.. I think it is totally wrong.. We don't know somethings until we experienced them.. It is even getting more common these days women molesting guys also. For real.. This happened 2003 at lautech, I'm a kind that jokes and play with ladies a lot, infact when you see me playing with girls you can callme a flirt or so.. My girlfrnd onced got jealous because of the way I do play with girls.. I didn't really see anything wrong in being friendly with opposite sex.. Not until a day, which was meant to be hostel week.. Where girls visit guys in the hostel and same with guys also.. That was the week I experienced rape.. Infact I wasn't the only one.. As someone that got so many female friends I decide to go visit some of my female friends at their hostel, though the hostel wasn't in the school, but that particular building is for female students only..I got their around 6pm, in which I met one of my close course mate onyiye, in which she took me from the gate to their room, as I was even following her I saw some other guys but few inside the hostels with their girlfrnds I guessed.. So I didn't see anything wrong.. Onyiye took me to their room, they were 5 in the room but racheal, mirabel and seun weren't around at the moment it was just onyiye and dorcas.. I entered we greeted and all that, we started gisting and so on! Dorcas was on her bunk listening to music, I and onyiye gisted more, while dorcas was contributing little.. Before a while the other 3 girls came in, we strted full gist to the extent that they made food and I gave them 500 to get drinks we drank and enjoyed ourselves, before I knew it , it was around 10pm.. And the time meant for male visitors to leave the hostel was 9pm.. That is from 5pm to 9pm.. Immidiately I was at alert and some of them were even asleep, I decided to tell onyiye to see me off, she was like if the portal or secuirty catches me dey will arrest me which wll be an issue that they will see what they can do to convince the man if he can allow me pass the back gate..I said no wahala, as onyiye and dorcas with seun went to talk to one of the security female, after a while I decided to walk down the stair case all alone to see if they are coming back and the way forward cos I can't sleep in girls hostel na. . As I saw a female hostelite coming my way I quickly ran into a room thinking it was my females friends room without knowing it was another room entirely, I saw the girls in the room some naked, some are on pants only and they were amazed, and shocked.. Guy in the room? As I was about to go out, they grabbed me pushed me on the bed and tore my cloths.. To cut the story short the experience wasn't funny at all, I nearly fainted, if not when my female friend in the other room heard me screaming cos I was almost weak, they came rescuing me, I didn't know how I got to the clinic that night.. My manhood was uselessed.. I serviced more than 5 girls at once,, it was terrible. Rape issue is bad and must be stopped! Let's also leave the mentality that female are the only victims! No! Thank You For those saying this is lie,I can't really go deep to tell you the full details my story, I had a friend a guy who was raped by girls at uniport to death.. , he couldn't even stand to walk.. Pray it shouldn't be an experience to you.. |

Ugandan President, Yoweri Museveni, has criticised US President, Barrack Obama, over his remarks about African leaders’ failure to respect presidential term limits and clinging to power for life. He said on Wednesday at a joint news briefing with his Kenyan counterpart, Uhuru Kenyatta, at State House, Kampala, that Obama and other western leaders should respect the will of Africans who “democratically” elect their leaders. Yoweri Museveni of Uganda Yoweri Museveni of Uganda Obama, had during a keynote address to Africa Union’s 54-member nations, in Addis Ababa, during his visit in July, called on African countries’ presidents to respect their constitutions and step down at the end of their terms. “I just don’t understand the phenomenon of leaders who refuse to step aside when their terms end. No one should be president for life. “There is still so much I want to get done to keep America moving forward, but the law is the law and no one is above it, not even presidents,” he had said. Museveni said “for those who focus on term limits, we don’t think they are correct. “Africa is not a back world because of term limits, but because of its lack of federation, common market, infrastructure and security. “I don’t know what he meant; I don’t care, that is none of my business. ‘’For us in Uganda, we rejected this business of term limits. If I am in power because I am voted by the people, then I am there by the will of the people”. It would be recalled that Ugandan parliament had, in 2005, voted to scrap the two-term presidential limit in the country’s constitution. According the Museveni, there are usually elections in Uganda and every five years the people have a choice to make. “We are going to have elections here; Ugandans will tell you about the term limit. “I have no apology to make to Obama; it’s only the US which has term limits. Look at Israel, UK and Germany, they don’t have term limits. The sixth annual summit will highlight investment, innovation and entrepreneurship in sub-Saharan Africa. AFP PHOTO US President Barack Obama “Look at Tunisia, with confusion from some western countries; they voted for a man of 88 years old. They were stuck, having made a lot of mistakes,” he said. Museveni, who has been in power since 1986, last week picked his ruling National Resistance Movement party’s nominations form to run as its presidential flag bearer for the fifth term in office in the 2016 polls. On his part, Kenyatta told reporters that the popularity of a leader in a country was not determined by term limits. “If Ugandans have chosen no term limits, I don’t see the problem with it. “If it’s people’s desire, you must abide by the will of the people. We need to respect the democratic will of the people in the country or region,” he said. Kenyatta insisted that what must be respected is the popular will of the people. He said that the popularity was all about how much peace, development, progress and stability you give to your people. He said that time had come to always allow people to choose their leaders through the ballot rather than by imposition. “We must focus on prosperity for our people, infrastructure, federation and security,’’ he said. - See more at: http://www.vanguardngr.com/2015/08/term-limits-africa-not-backward-museveni-replies-obama/#sthash.eprdnUrF.dpuf |
