May be the prosecutors, investigators, IPOS, etc, did not do their jobs well enough to secure conviction, sentencing, prima facie evidence might not have even been adduced!...................in the absence of the necessary facts, evidences, witnesses and even complainant as the case may be...............the court of law will have no option than to free, discharge and in some instances acquit the accused person.............according to the provisions of the 1999 Constitution, criminal procedure code, evidence Act and other relevant and related statutory provisions, where the prosecution fail to tender proof beyond reasonable doubt, and in the absence of voluntary confessional statement from the accused, the will have no option than to free him. For, it is better for the court to free 100 guilty persons, than to convict one innocent man.
