Their objection is rested on the provisions of Paragraph 4 and 5 to the 1st Schedule to the Electoral Act.

It is settled that a petition must be filed within 21 days against the result of an election. The document that should accompany a petition are in Para 4&5.

Just another reminder about this forms & what they represent because you will be coming across them during proceedings.


Form EC8A ;
is the pink slip at the polling unit level where every polling agent sign the result.
It is the first point of collating votes

The EC8B :

is the form used at the Ward where they compile all the form EC8A above and input the number of votes from there into the EC8B
It is the Ward computation form.

Then next is EC8C, which is used at LGA to compute total of votes per wards.

Then the form EC8D is for the State. So they compute all the LGA votes and record it here.

The EC8E is what is used for concluded signatory result.
This is what is used to declare the winner.
It is the final sheet for declaring the winner of the election.

- During the examination,the witness told the court that he didn't vote and that he is a software engineer who investigated and made findings about the issues bothering on the failure of the first respondent [ INEC ] to transmit directly from the polling units.
This his investigation,he said,was found upon the provisions of the electoral law Act 2022 and other supplementary laws,INEC interviews at Chatham house and several publications made by INEC.

-After the witness examination exercise,the petitioners moved two motion before the court which was an application for the interrogatories directed at the first respondent.
All the Respondents also adopted their response to the motion and asked the court to deny the motion of the petitioners.

- Prof Paul,for the petitioners,proceeded to tendering documents of INEC certified forms EC40G [ This is an incident report from which shows data of polling units cancellation and other in incidents. ]

- Due to time constraint,the petitioners were only able to tender certified copies of forms EC40G for eight Bayelsa state,and as expected,all the respondents objected to it admissibility,however,the court admitted them and marked them as exhibits accordingly.

-At this point ,the petitioners sought for adjournment,and which all the respondents didn't object ,and the court adjourned the matter till 9th June 2023.

But before we proceed,I will love to give you a summary of what transpired in court yesterday,8th June 2023.

-The court sat at about 2.47pm and the petition of Peter Obi & Labour party with petition number CA/PEPC/03/2023 was immediately called.

-Among all others, notable people who were in court include but not limited to Peter Obi,Dele Farotimi and Julius Abure.

-Peter Obi represented the petitioners [ himself & labour party ].

-All other parties were not represented in court.

Lead Counsel:

°Dr.Livy Uzuoukwu SAN led the petitioners [ peter Obi and labour party].

°Abubakar Mahmood SAN led the first respondent [ INEC] legal team.

°Chief Akin Olujimi SAN led the 2nd & 3rd Respondents [ Tinubu & shettima] legal team.

° Lateef Fagbemi SAN led the 4th respondent [ APC] legal team.

-Patrick Ikwueto SAN and Prof. Paul Ananaba SAN conducted the proceedings on behalf of the petitioners.

- The petitioners opened their case with the calling of a witness.
They called only one witness.

- After the witness took the oath of truth,the petitioners conducted their examination-in-chief [ the first examination of a witness by the person who calls the witness ].
And this was followed by cross examination by all the Respondents of the case.
The petitioners however,chose not to re-examine the witness and the witness was asked to leave the witness dock.

Justice Tsammani is not having it as he has been complaining about the documents tendered and arrangements of the schedules.

Justice Adah has also complained and they are putting all the schedules page by page to locate the missing LGA.

1st Respondent:
