AutosRe: Beware Of Kayode Fagbenro - Cotonou “Clearing Agent”, “Car Dealer” by inspiredm(m):
Kaymed: @ Inspired

I really appreciate your work as a moderator on this forum and also a dealer, it not an easy task at all, Kudos to you. I will like to make something clear to you on this issue Mr. Moderator.

When a buyer and seller are having issue like this, you have to be neutral and try as much as possible to gather concrete evidence before you take your decision. Lawrence was my client and I think that if I have done anything wrong to him. He accused me of extorting him, apart from the 400k I charged him and he paid me willingly, did you asked him if he gave me any other money?
You claimed that general cotonuo clearing is 400k CEFA, what are you insinuating? This is confusion and selfish statement. Normal Custom clearing in cotonuo is 450k Cf and you will have to pay for security, battery and imported card which is not inclusive in the 450k Cf. if you are clearing cars in Cotonuo, you will pay for security, battery and imported card which varies but at the range of 55k cf to 80k cf depending on where you buy your car. Total cost of clearing cars at cotonuo cars market is 550k Cf maximum
AENAIJA: 1.

Kaymed NEVER charged me NGN400000 for Cotonou clearing so I never agreed to that.

He charged me NGN1.3M as a package deal for Cotonou & Seme clearing and delivery to Lagos. I never asked for breakdown of Cotonou portion or Seme portion. I was given one package price and that was it and that was fine by me. Why would I ask for component pricing when my aim was to get the car to Lagos. Since my aim is to deliver the car to Lagos, I am interested in only ONE price - the cost to get the car to Lagos, not the individual components that make up that package price. When you go and buy a car, do you ask - how much is the engine, how much is the tire? No! You ask how much is this car!

4. On the basis of the NGN1.3M package price, Kayode asked me to pay him all or at least NGN1M upfront to "start work".

I then wired NGN500000 to his account EVEN before I met him that Thursday May 10, 2011.

5. When I then met him at Seme he then said in order not to waste time in going to the bank to retrieve funds i.e. the NGN500,000 I had already transferred to him, I should give him more money out of the balance of NGN800,000 (I.E. 1.3M - 0.5M) so that he could have that on hand in Cotonou. I asked him how much and he said 400000. So I gave him NGN400000. He NEVER EVER said 400000 was my Cotonou clearing fee and why should he. We were always working on a package price of 1.3m. The truth is when Kayode said 400000, he meant 400000CFA. I foolishly gave him 400,000NGN as any Nigerian would do - since NGN is our currency and we were in Nigeria. Instead of him to correct me, he keeps the money. Now this would not have been an issue if he had ultimately delivered the car to Lagos at 1.3M - the package price. If I got my car in Lagos for 1.3M would I be asking him , Kayode how much did you spend in Cotonou? Of course not, he would have fulfilled our agreement to deliver at 1.3M and that's would be a successful conclusion.

6. When he started his extortion games, I then asked him for a refund of my funds, he then claimed that the NGN400000 I gave him was used to pay Benin government for clearing. Obviously, as he admits above no one paid Benin Govt NGN400000.

7. So let it be ABUNDANTLY clear, I NEVER AGREED TO PAY KAYMED NGN400000 for Cotonou clearing. I only agreed to pay NGN1.3M for a package deal. Kayode now chose to seize my NGN400000 when I demanded for a refund claiming he had paid it to Benin Govt and to quote him: "you know you cannot get refund form govt'. of course we now know that is a lie, as he did NOT pay Benin govt NGN400000. He even implicitly admits this above.

8. Furthermore when I asked Kayode twice for a breakdown of the Cotonou expenses and documentary receipts, he refused to give this to me. If we did truly agree to NGN400000 he would have gladly have given me the breakdown AND receipts, but he knew he couldn’t because he had embezzled the NGN400000.

9. I also suspect that the 370,000CFA "for further expenses' that I was forced to pay and the 40000CFA for 'parking" is the ACTUAL amount used for clearing the car in Cotonou. My hunch, is that Kayode siezed my NGN400,000 and frankly embezzled it. The Cotonou agent he now used for the job was possibly not even paid for his Cotonou clearing services, hence the final demand made of me by Kayode for this 370000 + 40000 CFA - in order to settle the Cotonou agent for his clearing services, as Kayode was determined to keep my NGN4000000. Basically, Kayode seized my NGN400000 and then wanted me to now pay under the guise of "further expenses' the actual CFA cost of clearing in Cotonou. So I paid double for the same job. NGN400000 to Kayode which he basically embezzled, then CFA410,000 - which I strongly suspect was the actual cost to clear the car

10. Wise Nairalanders, who have followed this thread, know the truth here: Kayode played the classic "bait and switch" game and was determined to extort and extort money from me possibly without end. That is not in dispute. It is also not in dispute as Kayode admits above that the NGN40000 he post facto claimed to be the cost of Cotonou clearing was NOT the cost of Cotonu clearing. So he embezzled my NGN400000. He frely amdist inhis post that Cotonou clearing is 450000CFA with a possible max of 550000 CFA. Those are his words. The Cotonou/Benin govt fee for in transit cars is fixed. It’s public information. We all know that So why did he now claim that he spent NGN400,000 (1,250,000 CFA) to clear the car. SO why did he now charge another (410,000 CFA) for “further expenses and parking. Nairlanders, can you not see the duplicity Here. He admits Cotonou clearing is 550k max (a figure that many would argue is on the VERY high side) …yet, he took from me - 1,660,000CFA!!! .

11. Kayode, you have hurt me DEEPLY..not because of the financial losses you made me incur, not just because you cheated me, but because you betrayed the trust I placed in you. In a short time I came to trust you and took you as a younger brother. I considered you a friend. I even in the spirit of friendship, bought you a gift after my last trip which I immediately gave you when I first saw you on that fateful Thursday, May 10, 2012..yet that same day you cheated me of NGN400000 and played a bait and switch on me. What a tragic shame!

12. Kayode if you are an honest me, the best way to redeem yourself, since you admit that NGN400000 was not the cost of Cotonou clearing. REFUND ME MY NGN400,000! Accept your folly, your mistake and issue me a refund immediately. This singular act would be a testament to your remorse and repentance. And that is what an honest man would do! Without that refund…you will be always known here as a man who cheated his fellow Nairalander and you will have to bear the moral and spiritual repercussions of your evil act

13. The truth is clear for all to see. Nairalanders PLEASE learn from my experience and beware of Kayode/Kaymed. I have nothing more to add to this matter.

From the Statements Gathered and In Essence, It means you Spent 1,660,000 CFA ( N534,500 ) to Get your Vehicle Out of Cotonou to Seme Border.

Also Going by KAYMED's Statement. It shouldn't Cost more than 550,000 CFA ( N177,000 ) to Clear same Car from Cotonou to Seme Border.

You have Stated that Clearing from Cotonou to Seme Border is 550,000 CFA ( N177,000 )

AENAIJA has Stated that He has Paid you 1,660,000 CFA ( 534,500 ) So Far and You Cleared the CAR up till SEME Border.

This Leaves a Balance of N357,000, ( Yet Unaccounted For )

If AENAIJA Never Agreed to Any Payments For Clearing to SEME Border and at the Middle of the Transaction You decided to Switch On him probably because His Money was With you, then that is EXPLOITATION & EXTORTION and it is FRAUDULENT.

@ the beginning of this Thread, AENAIJA Did not ask for a REFUND, His Intention was to "warn" others about his Experience, But at this Moment and After your Explanation, he has Asked for a REFUND.

KAYMED, Are You Willing to Refund AENAIJA the Sum of N357,000 or Is this Your "PROFIT in business" for Clearing From Cotonou to Seme Border ?

@AENAIJA, Thanks for the Detailed Explanations Afterall.

It is rather Unfortunate that some People Want to Ruin what we have so Far Labored to Build on this Section.

Your Experience was the Classic "Bait and Switch" and It is Nothing BUT Plain Extortion which Explicitly is Fraudulent.

From my Knowledge, the Standard price of Cotonou Clearing to Seme Border is 400,000 CFA ( 128,000 Naira )

I would Not Fault the Price Charged by KAYMED from Clearing from Cotonou Ship-Side to Seme Border even though it Reeks of GREED, it was mutually agreed btwn Both of you and He delivered same.

On the Other Hand, Kaymed Should have done his Proper Valuation Assessments Before Giving you Quotes, The Price Difference Of 700,000 Naira in a timeframe of Less than 24 Hours is Only NOT Ludicrous, it is Ridiculously Irrational.

Also, You being made to Pay Other Expenses like "Further expenses and Parking" totaling 135,000 naira at Seme Border is Highly Inconsiderate of Kaymed.

On this Basis of FRAUD and to serve as a Deterrent to Others, Kaymed Will be delisted from Our List Of Auto Dealers.

He shall Also Be Served with a 3 Weeks BAN which takes Immediate Effect. ( I Will Not BAN him Permanently Simply Because He refunded 800,000 Naira and didn't choose to Bolt away )

We want to Assure all that We have Zero Tolerance for Fraudulent Activities and Scammers on this Section, Also We Wish to Reiterate that Buyers Should not Throw Caution to the WIND When Dealing With Anyone Irrespective of what they see or Read.

The Onus Still Lies On Buyers To Pursue all Logical Means and Verify Whoever they chose to deal With Before Parting away with Money.

We are Committed to making the Autos Section The Best it can be.

Cheers
