A State High Court sitting in Abakaliki, Ebonyi state capital Monday dismissed the suit challenging the defection of governor David Umahi from the People’s Democratic Party (PDP) to All Progressives Congress (APC).

Umahi, who in 2015 and 2019 won the governorship seat of the state under PDP, joined the APC in November 2020.

The plaintiff in the suit, Sen. Sunny Ogbuoji, was the governorship candidate of APC in the 2019 election and came second in the race.

Ogbuoji had approached the court to determine whether governor Umahi having defected to APC can still continue to be Governor.

He cited the provisions of the 1999 constitution as amended and the Electoral Act to push his argument in court.

But the presiding Judge, Justice Henry Njoku, while delivering his judgment, said the plaintiff was relying on the pre-election/election qualification issues.

Justice Njoku further noted that there is no provision in the constitution that provides for defection as one of the grounds for vacation or removal of a person as Governor or as Deputy Governor.

According to him, “Considering the submissions of both parties, the Court held that having regard to section 188 (1) of the 1999 Constitution as amended, the defendant (Governor Umahi) has not offended any provision of the Constitution or the Electoral Act in his defection to APC.

“The Court further held that having regard to section 308 of the Constitution, it is even wrong to institute criminal or civil proceedings against the office of the Governor.
“The Court, therefore, dismissed in its entirety, the suit filed by the plaintiff for lacking in merit and awarded Five Hundred Thousand Naira (N500, 000.00) as damages against the plaintiff.”

The Supreme Court, on Monday, slated May 2, 2022, to deliver judgment in a suit filed by the former governor of Rivers State, Chibuike Rotimi Amaechi, seeking to stop his probe in alleged N96 billion fraud and alleged fraudulent sales of assets belonging to Rivers State.

A seven-member panel of Justices of the apex court led by Justice Olukayode Ariwoola announced the date for the judgment after talking arguments for and against the suit.

Amaechi who is currently the Minister of Transportation is praying the apex court to prohibit Governor Nyesom Wike from investigating his eight-year tenure as the executive governor of the state.

The former governor represented by Prince Lateef Fagbemi (SAN) predicated his opposition to the probe on the ground that it was aimed at witch-hunting him, to embarrass him, humiliate him and disgrace him in view of his political differences with his successor.

Wike who constituted a seven-man panel to investigate Amaechi, on his part, is asking the Supreme Court to dismiss Amaechi’s suit.

The governor, represented by Emmanuel Ukala (SAN) insisted that the Commission of Inquiry headed by Justice George Omekeji was to look into how N96 billion was allegedly withdrawn from the Treasury of the state government and how it was expended.

Wike also said that the Commission of Inquiry was to look into the lawful or otherwise, sales of valuable assets of the state.

The listed valuable assets are Omoku Gas Turbine, Afam Gas Turbine, Trans Amadi Gas Turbine, Eleme Gas Turbine, Olympia Hotel and the award of contract for the execution of MonoRail Project.

Minister of Foreign Affairs, Geoffrey Onyeama says no fewer than 204 Nigerians living in Ukraine have been safely received and provided accommodations by officials of Nigerian Embassies in Romania and Hungary.

Onyeama disclosed this in a statement signed by the Permanent Secretary, Ministry of Foreign Affairs, Amb. Gabriel Aduda and made available to News Agency of Nigeria (NAN) on Monday in Enugu.

The minister said that the affected persons were currently being documented and awaiting final arrangements to be brought back to Nigeria.

He said that officials of the embassy at Bucharest, Romania received 130 Nigerians while those in Budapest, Hungary safely received and accommodated 74 Nigerians.

He said that another batch of about 200 were expected in Budapest on Monday, Feb. 28, 2022.

The statement partly reads: “In the last 24hours, officials of the Nigerian Embassy have received 130 Nigerians safely at Bucharest, Romania where they have been provided accommodation.

“Also, officials at Budapest, Hungary, have received and accommodated 74 Nigerians safely, where they are being documented for subsequent travel arrangements back to Nigeria.

“In Warsaw, Poland, we have received 52 Nigerians and 23 are being processed at the Polish Government Reception Point at Hala Kijowska, Milny 90, 37-552 Milny, which is near the border of Korczowa-Krakowiec.

“The camp is well organised with beds and beddings, food, heating, clothing and materials for evacuees,” he said.

Onyeama assured Nigerians that arrangements were being put in place to effectively and safely evacuate Nigerian citizens in the war-ravaged areas.

Hon.Musa Agah of the People’s Democratic Party (PDP) has been declared winner of the Jos North/Bassa Federal constituency by-election by the Independent National Electoral Commission (INEC) on Sunday.

The returning officer Dr Oyeyinka Oyerinda announced Agah scored 40, 343 to beat the PRP candidate Hon. Muhammad Gwani who scored 37, 757 votes.

Hon. Abbey Aku of the ruling All Progresives Congress (APC) polled 26,111 votes.

Senator Istifanus Gyang of Plateau North congratulated Agah for the victory.

The Senator, in a statement by his media aide, Muas Ashoms, said the defeat of the APC is a verdict on the inglorious election phobia of Governor Simon Lalong which saw PLASIEC deny the PDP participation in what ought to have been a keenly contested local government elections in the State.

He said the victory signals good things to come.

The Electoral Act (Amendment) Bill 2022, passed by the National Assembly forwarded for Presidential Assent, via a letter dated 31st January, 2022. In line with established tradition, I received inputs from relevant ministries, departments and agencies of government after careful and thorough reviews of the Bill and its implications to democratic processes in our country.

It is gratifying to note that the current Bill comes with a great deal of improvement from the previous Electoral Bill 2021. There are salient and praiseworthy provisions that could positively revolutionize elections in Nigeria through the introduction of new technological innovations. These innovations would guarantee the constitutional rights of citizens to vote and to do so effectively.

The Bill would also improve and engender clarity, effectiveness and transparency of the election process, as well as reduce to the barest minimum incidences of acrimony arising from dissatisfied candidates and political parties.

These commendable efforts are in line with our policy to bequeath posterity and landmark legal framework that paves the way for credible and sound electoral process that we would all be proud of.

Distinguished Senators and Honourable Members of the National Assembly, from the review it is my perspective that the substance of the Bill is both reformative and progressive. I am making this bold declaration because I foresee the great potentials of the Bill. Worthy of note include the democratic efficacy of the Bill with particular reference to sections 3, 9(2), 34, 41, 47, 84(9), (10) and (11) among others.

This however, cannot be said about one provision as contained in the proposed Bill, which provision constitutes fundamental defect, as it is in conflict with extant constitutional provisions.

Section 84 (12) constitutes a disenfranchisement of serving political office holders from voting or being voted for at Conventions or Congresses of any political party, for the purpose of the nomination of candidates for any election in cases where it holds earlier than 30 days to the National Election. The section provides as follows:-

“No political appointee at any level shall be voting delegate or be voted for at the Convention or Congress of any political party for the purpose of the nomination of candidates for any election”.

This provision has introduced qualification and disqualification criteria that ultra vires the Constitution by way of importing blanket restriction and disqualification to serving political office holders of which they are constitutionally accorded protection.

The practical application of section 84(12) of the Electoral Bill, 2022 will, if assented to, by operation of law, subject serving political office holders to inhibitions and restrictions referred to under section 40 and 42 of the 1999 Constitution (as amended).

It is imperative to note that the only constitutional expectation placed on serving political office holders that qualify, by extension as public officers within the context of the constitution is resignation, withdrawal or retirement at least 30 days before the date of the election.

Hence, it will be stretching things beyond the constitutional limit to import extraneous restriction into the constitution on account of practical application of section 84(12) of the bill where political parties’ conventions and congresses were to hold earlier than 30 days to the election.

Arising from the foregoing, with particular regards to the benefits of the Bill, industry, time, resources and energy committed in its passage, I hereby assent to the Bill and request the Nationally Assembly to consider immediate amendments that will bring the Bill in tune with constitutionality by way of deleting section 84(12) accordingly.

Gunmen have attacked some commercial banks in Uromi, Esan North East Local Government Area of Edo State, a police official said.

The incident took place on Thursday afternoon, according to the spokesman of the Edo State Police Command, Bello Kontong. He said the attack led to substantial damages to the affected banks, noting that details about the incident will be communicated later.

AIB-N RELEASES REPORT ON QUORUM HELICOPTER CRASH, THREE OTHERS

The Accident Investigation Bureau Nigeria (AIB-N), today released four accident reports including that of Quorum helicopter crash, the only fatal accident in the country in the last five years.

The agency, besides the four reports also released a Safety Bulletin at a press conference held at her Abuja Corporate Headquarters. The fatal accident, which involved Quorum Aviation Limited Bell 206B3 Helicopter with registration 5N-BQW, occurred at Opebi, Ikeja, Lagos State on 28th August 2020.

Addressing the media, AIB-N Commissioner, Engr. Akin Olateru, disclosed that the causal factor of the accident was due to fuel exhaustion at low altitude and low speed leading to loss of control in flight.

He added that the pilot’s decision to continue the flight towards the intended destination with insufficient fuel instead of landing as soon as practicable in line with section 12.12 of Quorum Aviation Limited Operations Manual Part A, was part of the contributing factor that led to the fatal accident.

Other contributory factor, according to the Commissioner, was the lack of effective management supervision of the airline’s flight operations and inadequate safety oversight of Quorum Aviation Limited.

Three Safety Recommendations were, therefore, addressed to the Nigerian Civil Aviation Authority (NCAA) and the airline in the report.

In the other three reports and one Safety Bulletin released, the Bureau addressed a total of nine Safety Recommendations to the NCAA, the affected airlines, the Federal Airport Authority of Nigeria (FAAN), among others.

The released reports included the report on an accident involving Skypower Express Airways Nigeria Limited Air Tractor AT-401B Aircraft with registration 5N-BTV, which occurred at Rukubi Village 90 NM South-East of Abuja on the 4th October 2018.

The Bureau also released the report on the serious incident involving Nigeria Police Airwing Bell 429 Helicopter with registration 5N-MDA which occurred at Nnamdi Azikwe International Airport, Abuja on the 3rd August,2019.

Speaking with reporters on Tuesday after President Muhammadu Buhari held a meeting with APC governors, Nasir el-Rufai, Kaduna governor, said the northern zone would have the positions the southern zone held before. El-Rufai said all the APC governors and the president are on the same page as regards the zoning formula.

We have agreed to a zoning formula for all the six geo-political zones,” the governor had said.
Essentially, the northern zone will have the positions the south have had in the last eight years. And vice versa. It is a very simple, equitable and fair formula. We will now go back & consult at the zonal level & look at the positions that are available and the process of the convention preparation we started in earnest. The Zamfara House of Assembly has confirmed the appointment of Sen. Hassan Nasiha, as the state new deputy governor, following his nomination by Governor Bello Matawalle.

Mr Matawalle had in a letter signed by Secretary to the State Government, Kabiru Balarabe and read at Wednesday’s plenary by Speaker Nasiru Magarya, nominated Mr Nasiha as the new deputy governor after the impeachment of Mahadi Aliyu from office.

Majority Leader Faruku Dosara, moved the motion for the confirmation of Nasiha and was unanimously approved by the lawmakers.

The Speaker said that the appointment of the nominee was unanimously approved by the House due to his track record of service.

“Therefore, the house has approved the appointment of Nasiha as the new deputy governor of the state inline with the provisions of the 1999 Constitution as amended,” he said.

Mr Nasiha currently represents Zamfara Central at the National Assembly.

The All Progressives Congress (APC) has agreed on a zoning formula that will swap offices held between north and south.

By the arrangement, all offices that were occupied by northerners in the last eight years will go to the south and vice versa under the new arrangement.

This emerged following a meeting between President Muhammadu Buhari and 19 governors elected under the APC at the presidential, Abuja on Tuesday.

Also at the meeting were Vice President Yemi Osinbajo; Secretary to Government of the Federation (SGF), Boss Mustapha and the Chief of Staff to the President, Prof. Ibrahim Gambari.

Speaking while briefing correspondents on the outcome of the meeting, Governor Nasir el-Rufai, of Kaduna state, revealed that agreement had been reached on the zoning formula.

He said: “We have agreed on a zoning formula for all the six geo-political zones. Essentially, the northern zone will have the positions the south have had in the last eight years. And vice versa.

“It is a very simple, equitable and fair formula.

“We will now go back and consult at the zonal level and look at the positions that are available and the process of the convention preparation we started in earnest.

“So, by the grace of God, on the 26th of March, we would have done our national convention.”

Eighteen of the governors are in attendance at the meeting taking place at the Council Chambers.

They are from Yobe, Ekiti, Ebonyi, Jigawa, Cross River, Kaduna, Lagos, Borno, Niger, Gombe, Osun, Kebbi, Anambra dep, Nasarawa, Kwara, Kano, Imo, Kogi, Ogun, and Plateau states.

The outgoing deputy governor of Anambra State is also in attendance.

Governors of the All Progressives Congress on Monday declined to comment on the postponed national convention of the party.

Speaking after a meeting held in Abuja, Chairman of the APC Governors’ Forum, Atiku Bagudu, said the Governors will only comment after meeting with President Muhammadu Buhari on Tuesday.

“Until we finish the meeting with Mr President, we will rather not comment on any timetable or logistics,” Mr Bagudu, who is also the Governor of Kebbi State, said.

Other issues discussed by the forum, according to Mr Bagudu, include the just concluded FCT Council elections, the Osun primaries, among others.

The Governors, who attended the meeting at the Kebbi State Governor’s lodge include the Chairman of the Extraordinary National Convention Planning Committee and Governor of Yobe State, Mai Mala Buni, Professor Babagana Zulum of Borno State, Simon Lalong of Plateau State, Abubakar Bello of Niger State, Badaru Abubakar of Jigawa State, Yahaya Bello of Kogi State and Nasir El-Rufai of Kaduna State.

Others are Abdullahi Sule of Nasarawa State, Rotimi Akeredolu of Ondo State, Babajide Sanwo-Olu of Lagos State, Abdullahi Ganduje of Kano State, Dave Umahi of Ebonyi State, Abdulrahman Abdulrazaq of Kwara State, Dapo Abiodun of Ogun State, Muhammad Yahaya of Gombe State and the Deputy Governor of Anambra State, Nkem Okeke.

My good people of Osun,
Good day to you all.

Another electoral cycle has rolled by and we are now in that season again in Osun. We should thank God for the democratic right to participate in the electoral process of electing our leaders.

As you all know, this is a two staged process. The first is intra-party, meaning that our party, the All Progressives Congress (APC), will democratically nominate its candidate. The second stage, inter-party, will take place in a state-wide election sometime in July, God willing.

For this first stage, I am appealing to all our party members to participate but peacefully in the primary election taking place today. They should avoid any form of violence, brigandage and disorderliness.

Our party members, especially our supporters, should be resolute to cast their vote, not to be intimidated and scared away. But they should portray themselves and the party in the best form in comportment, organisation and promotion of societal peace and tranquillity.

You should know that we are first a community of humans before we are a political community. Our peaceful coexistence therefore supersedes every other activity.

The Nigerian and our party’s constitutions make provision for the expression of our preference and choice of leader every four years. This is the heart of the democratic process. It is an inalienable right we should take as sacred and exercise with every sense of responsibility.

I am also appealing to our members to push out the women and let them lead the process by coming out decently and peacefully. This is to demonstrate the customary dignity of women as matriarchs, mothers, wives and daughters, which confers on them the special protection status from violent attacks from thugs and hoodlums.

Our overall objective is to have a transparent, free, fair and peaceful election.

I wish us all a peaceful, free, fair and successful primary election.
