Operation of the Tax Invoice
(a) Regulation
The FIRS has taken steps to provide in the Act specific obligations on taxable firms. The statute states that "each Taxable firm is obligated to issue a Tax Invoice at the time of delivery of a taxable good or service". This means that only a taxable firm is obligated to issue Tax Invoice and without fulfilling VAT registration requirement, the firm will have no right to Issue Tax Invoice. It is an offence however for a taxable firm to fail to register for VAT as well as failure to issue tax invoice when it is already confirmed to be doing business. Stiff penalties have been provided in the VAT Act to check these abuses. Section 32 of VAT Act.
The Tax Invoice should be issued at the time of delivery of the taxable goods or services. This emphasizes that the tax is due at the time of delivery and not at the time of payment. An exception to this rule may exist only where payment is received before the deliveries.
(b) Requirements of a Tax Invoice

The Tax Invoice must contain the under-listed information which relates to the taxable deliveries. These are:
• name, address and VAT registration number of the firm that delivers the taxable good or Service.
• name and address of the person/company receiving the taxable good or service
• description, type, number, unit price and total sales value or consideration of goods sold or purchased
-value added tax (VAT) charged or collected and rate applied
• date of delivery.

Penalty Provisions
Section 29 & 31 of the VAT Act provides stiff penalty for failure to issue tax invoice. A person who fails to issue tax invoice for goods sold or services rendered is guilty of an offence and liable on conviction to a fine of 50% of the cost of the goods or services for which the invoice was not issued.

Taxable firms are free to print their Tax Invoice from any source, but they must ensure that their registered addresses and VAT registration numbers are printed on the Invoices.

Cash Registered for Retailers
Requirements
Every trader who carries on businesses! Restaurants, hotels and other similar businesses will be required to install a cash register machine for the business or issue tax invoices whichever is convenient, on which the consideration for supply is based. For this category of taxpayers, particularly where invoices have not been issued e.g. Supermarket stores turnover figure will be presumed as VAT-inclusive and the implication here is that because the taxpayer has installed a Cash Register Machine he is deemed to have performed his obligation of bookkeeping and issuance of receipts. VAT will then be charged based on his total cash receipts.

Where the tax has to be paid

The older rates that were imposed by the government have also been revised in the 2011 amendment and it has made sure that the person earning over 3.2 M Nigerian Naira are charged at the revised rate of 24% as compared to the older rates for which the threshold was set at 1.6 M Nigerian Naira and the rate of tax was 25%. 4. Interest on the WHT or withholding tax will be the same as that of the interest of the monetary policy of the Central Bank of Nigeria.
5. Previously the filing date of the income tax return was 31st March that has been changed to 31st January.
6. The 5% of the total revenue collected by the tax authorities of any genre has to be withholding to make sure that the administrative expenses are met.
7. Tax officers or inspectors are now bound to contact the high court to seek the warrants in case any of the individual tax payers has not submitted the return within time as per the rules and regulations defined by the law.
8. Corporate bonds that have been purchased by the individuals are exempted from tax as compared to the law that prevailed before.
9. Individual tax clearance certificates are now mandatory to change the ownership of cars and other vehicles and land title transfer.

Failure or the refusal to keep adequate and the proper books of accounts for the purpose of computing personal income tax is a very big offence. This on the conviction carries a penalty of N50, 000 for individuals and N500, 000 for corporate employers. The failure to deduct Personal Income Tax, where a person, employer or corporation obligated to deduct tax or having deducted Personal Income Tax fails to remit the tax deducted to the relevant revenue authorities within 30 days from the days the amount was deducted or obligation to deduct the tax arose, such a defaulter shall be obligated to pay (i) there is a penalty of an amount of 10% of the Personal Income Tax not deducted or remitted in addition. (ii) Paying the tax withheld or not remitted (iii) paying interest at the prevailing monetary policy rate of the Central Bank of Nigeria on the latter of the two items.

The amendment now allows the accountant general of the federal republic of Nigeria to deduct directly from the budgetary allocation of any government agency. The PIT is composed of direct assessment for self-employed individuals, and Pay As You Earn (PAYE) for salaried individuals. PAYE is a method of collecting PIT from the salaries and wages of individuals through deduction at source by employers as provided by relevant sections of the PITA. The tax is usually collected from an individual by the government of his/her residential state. The income tax rate of resident individuals varies from 7 per cent to 24 per cent on the basis of taxable income. The minimum tax rate is 1 per cent of gross income if the taxable income is below N 300,000.
Tax on non-resident Nigerians is levied on income which is based on Nigerian sources. A non-resident’s income from employment or business is taxed in the manner similar to that of a resident Nigerian. Expatriate employees of a non-resident company who are present in Nigeria for more than 183 days in a 12-month period, shall be considered as resident individuals for PIT if their employment costs are charged to a Nigerian company or borne by a fixed base in Nigeria. However, if the expatriates are liable to tax in another country that has entered into a double tax avoidance treaty with Nigeria, then such individuals shall be exempted from PIT in Nigeria.

Besides individuals, personal income tax is also collected from communities, families and trustees. PIT on a community is imposed in accordance with the law of the corresponding domicile territory. PIT on communities is levied when it is found impracticable by relevant tax authorities to assess individual incomes. A family recognised under any law or custom in Nigeria is subject to PIT if the interests of individual members of the family are indeterminate or uncertain. Trustees of settlements or trusts and executors of any estate of a deceased person are subject to PIT, and it is imposed by relevant tax authority whose territorial jurisdiction is decided by Second Schedule of PITA.

Non-taxable deductions under PITA include National Housing Fund contributions, National Health Insurance Scheme contributions, Life Assurance Premium, National Pension Scheme and gratuities.
