Political appointees will not be allowed to vote or participate on Saturday at apc convention.
The All Progressives Congress has barred political appointees from voting at its national convention holding on Saturday.

The party made this known in a press statement on Thursday.

The statement was titled, ‘Attention to political office holders who were elected as delegates’.

It read, “The National Caretaker Extraordinary Convention Planning Committee of APC has declared that all political appointees who were elected as delegates to the National Convention slated for 26/3/2022 SHALL NOT VOTE in view of the controversy surrounding Section 84 (12) of the Electoral Act,2022.

“However, political appointees can still attend as observers.”

The Senate had earlier unanimously rejected Electoral Act Amendment Bill sent by the President, Major General Muhammadu Buhari (retd.).

In the rejected bill, the president asked the National Assembly to amend Section 84(10) of the Act to allow political appointees to contest and participate in the primaries without resigning.

Section 84(10) of the Act specifically reads, “No political appointee at any level shall be a voting delegate or be voted for at the convention or congress of any political party for the purpose of the nomination of candidates for any election.”

Unknown to many members of the public, a lawyer and chieftain of the Action Alliance party, Mr Nduka Edede, approached a Federal High Court sitting in Umuahia on the matter – in a suit marked FHC/MU/SC/26/2022, with the Attorney General of the Federation as the defendant.

The plaintiff asked the court to determine whether Section 84(12), when read together with Sections 66(1)(f) 107(1)(f)(137(1)(f) and 182(1)(f) of the 1999 Constitution, was not inconsistent.

The judgment, delivered by Justice Evelyn Anyadike, nullified Section 84(12) of the newly amended Electoral Act, saying it violated the provisions of the Constitution.

Anyadike held that the section was unconstitutional, invalid, illegal, null, void and of no effect whatsoever, saying it ought to have been struck out.

A few hours after the judgement was delivered, the Office of Attorney General and Minister of Justice announced Federal Government’s plans to implement the court judgement allowing political appointees to run for office without resigning.

Some of the President’s ministers who are said to be planning to run for different offices include the Attorney-General of the Federation, Abubakar Malami, who is said to be eyeing the Kebbi State governorship seat; the Minister of Aviation, Hadi Sirika, who is believed to be planning to contest the governorship of Katsina State; the Minister of Transportation, Rotimi Amaechi, who is rumoured to be eyeing the Presidency.

Others who are said to have political ambitions include the Minister of Labour and Employment, Senator Chris Ngige; the Minister of State for Education, Chukwuemeka Nwajiuba; and a few others.

On Wednesday, March 23, the Senate resolved to appeal the judgment by the Federal High Court in Umuahia, nullifying the provision of Section 84(12) of the Electoral Act 2022.

Shame on Malami particularly for his role in planting that plaintiff that went to Umuahia to collaborate with d Anyadike judge. The annoying thing is that just like d days of Arthur Nzeribe, the Nigerian Northern elites will always use a pliable Igbo man to destabilize d polity. Nnamdi Kanu got a favourable judgement at Abia court Malami will pretend that it's after all Abia court and ignored it but his speed of trying to implement this kangaroo judgement still from Abia exposed his interest and thank goodness for people like Wike and PDP in general that sustained d heat tempo on this wicked APC.

The lawmakers inserted that controversial section not because they love Nigeria or Democracy, or really want to get things right, but obviously out of their own characteristic selfish interest.

my only question about your post is simple, how will a political appointee not voting in a primary election solve the problems of this country?

Nigerians are very gullible I swear!

That sham of an electoral act will not solve the problems of our electoral system.

So whether they vote or not, nothing will stop the dollar from getting to 600 naira/$.
So be more concerned with good leadership and stop wailing like a hungry child.

That section of the electoral act is irrelevant to me and other well meaning Nigerians.

Smart move...but the yam pepper scatter scatter that would play out after the convention will be very large.

Buhari's nonchalant attitude and poor leadership for the APC is what is causing this confusion and disorganisation in the party.

But who cares, anything to rule out both thieving ancestors (Atiku and Tinubu) is good enough for me. I don't want either of them running on APC or PDP platforms, let them join other parties to waste their stolen funds.

A smart move by APC.
There goes the hope of PDP and some bad elements in APC to get APC out of the ballot in 2023.

A safe approach which means that if the Appeal Court set aside the HC judgment, APC is fine. And if the Appeal Court agrees with the trial court, the party is also on track.

Let me keep watching this political movie series. It’s getting more interesting.

If all cases are determined at the same speed that case was determined, we would have had one of the very best judicial system in Africa.

APC met a 9" block at 180 but 7 years later, a 6" block is 380.

APC met a bottle of G.oil at 400 but 7 years later, a bottle of Groundnut oil is 1,100

There have been fuel scarcity since January ending, yet APC kept saying subsidy for February, March increased, what did they use the subsidy to import? Herdsmen?

Yeah! You are right to an extent.

But don’t forgot the hanging legal battle on the legality and legitimacy of Buni as the chairman of the party. Has it been finally resolved in their favour and I missed it?

I am sensing a gang up and implosion after the convention sha.

The Judiciary is already giving notice that it will no longer be a party to compounding Nigeria’s woes.

I might be wrong anyway. But there yet too many unresolved legal issues.

They have two options not to contravene the section 84 of the electoral act, because they don't know yet if Supreme court will remove or sustain it..

1. To elect their officers by a consensus and avoid any voting

2. Prevent political office holders from voting

Since it appears they cannot reach consensus..then, they have to prevent the political appointees from participating in voting
