I got paid 75% on a contract. 25% is still due. Client said he is not satisfied with my delivery. I said in that case I will be back. I took a month to prepare....it's services not goods, I spent a month working on the issues, then I wrote the client back, I am ready for you now.

To ask for my balance without satisfying the client is as immoral or more immoral than trying to get free services.

Even more so when this is a client that has sent funds in the millions your way.

By failing to satisfy the client you have basically cut off yourself from his network, remember that this is how money circulates among the rich and from the rich to the not so rich, by introductions and referrals.

Only a vendor who doesn't care about the future will prefer a little morsel over the enormous goodwill that satisfying a client will being in terms of future business.

Again, this is someone I have counseled, advised, several times in the past and yet nothing changed. Again, talk is cheap, I have personally given him work of about 7m, if I intended to cheat him, it wouldn’t be now! Of all he had done for, this is the smallest! Let all who are defending come out and say they have given him such!!!

You need to be specific about your site location in the south east. There are distances and locations that you'll have to pay some abnormal fares. Somewhere in Oguta my client was offered #340K for 30 tons.

He felt l have been cheating on him but price has dropped within that space. I was pissed off by the way he puts it. He is an honorable.

Instead of pushing the money to my account as we used to, he now asked of the dealers number. Which l have sent to him. I deal with Damara intl.

I actually felt bad about the suspicion because l have been very honest with him.

I have made up my mind that from now henceforth, he will arrange for any supplies. I will not do those errands for him and l am not being paid for it. I have been doing it to keep that relationship.

I will stick to labour and supervision as stipulated by the contract.

Yes you can stick to labour and supervision as stipulated by the contract but someone like me values folks that go beyond the call of duty and proves useful, if appropriate.

If I were you I would show the client the proof of previous payments so he can see and understand exactly what happened.

Please don't jump on the bandwagon of disgruntled contractors and those who bait them to act out.

Unless your client is a raving lunatic he will understand that prices changes. You can't fault him for his suspicion, after all we are all Nigerians and we know the score. This may be an excellent opportunity to build a bridge instead of tearing one down.

I actually don’t intend to chook mouth but for learning purpose, let me share.

A supposed professional gave you a piece of paper and you expected it to work because someone said it’ll work sir. The next thing he travelled out of the country, leaving you and the contractor to make it work.

Then you start fighting with contractor and everyone on site due to overrun.

2x + 3 = 5x, Find x.
If this is construction, x could be pilfrage, design error (wider beams/columns), wastage etc which 99.999% of time are not covered in bills of quantities.

A BOQ document is a useless piece of paper without proper evaluation of its performance.

The only way you’d know a cctv installation is satisfactorily completed is when you’re able to view your cameras locallly and remotely and perform other functions as agreed in your scope. There and then, the contractor can get his balance.

Why the exception on BOQs? Even architectural designs, we review, review, review until the architect start crying but when we take BOQ, we start to find X just because a professional said it.

Unfortunately you can only find X when you’re already in the midst of the sh*t.

Why should a professional drop a document that should serve as a guide in a project only to show up when issues arise on the site.... He must either make it work or follow through.

To make BOQs work, treat the professionals who prepare them the same way you treat artisans and contractors on your project.
Pay them 50% upfront and balance at the end of the project when the document satisfactorily meet its expectation.

Anyone could be prepare any rubbish, get paid and walk away when there are no consequences.

Why some client can't be totally absolved of the blame, our artisan here need to do better Abeg...imagine Julius berger telling FG that the reason they could not deliver lagos ibadan expressway is because one of their workers injured on site...A job that was paid for!!!

The client (a member here too) ended up throwing the bill at my face.

Did you know that in a saner country like the US, when you hire a person who does not have insurance and he gets injured on your property while doing the job, it does not matter how much in millions you paid him to do the work, you are still liable.
You must pay his hospital bill and pay him for the days he is unable to work?

We still have a long way to go in Nigeria . Lawlessness makes every big man in Nigeria think he is an emperor and a slave driver.

I feel you plight but running errands is never part of the scope.

For reasons best known to the owner of the project, he can decide to make some changes. Don’t feel bad because of that. He’s only taking some loads off you.

The part you missed is that sometimes you could be initially contracted to do only one job in a site that requires 4 to 5 more previously undetermined jobs.

Let’s say to fix bathroom shower, but by time you started you discovered that pipes are broken.

By the time you agree out of good will to fix the pipe you discover that you have to tear down a concrete wall to do so.
By the time you break the wall , you realized that you have to build the wall back because “na you break am”
Is that how you met the wall when you came? Then you must paint it.

Las las, two days job you bargain for has turned to a week or two extra jobs with no agreed contract.

You dare not complain because you are a poor contractor who must satisfy oga homeowner. Whatever he likes, he pays you. After all, you already signed an agreement him. Or would you abandon the job halfway and risk being disgraced on Nairaland ?

I am facing the exact same situation.

The contract as awarded and the contract as the client expects it to be delivered are world's apart.
