Please, I Seek Legal Advise From Legal Practitioners On This Situation by Olayetan(m): 12:44am On May 03, 2022
My humble greetings to all,

I'm here to seek advise on the current situation I found myself with someone I gave my apartment to, I had secured an apartment in igando area of Lagos state last year Oct., in December same year, I started having some issues so I decided to sublet the apartment and move on.
The intention was to sublet it with my furniture while I strike a deal with new occupant to pay for the apartment along with the furniture inside, a friend of mine whom I barely know picked interest in occupying the apartment but she pleaded to pay the money in parts, our agreement was 500k total while she pleaded to pay the money twice.
I made it known to her that I will only hand over the keys to the apartment when she pays 90% of the total amount then the 10% balance after a month they move in and she agreed and said she was going to pay me 90% by Jan/Feb and balance by March.
That was our initial agreement but then she sent me 200k in January 3rd week and called me in 4th week to hand over the keys and promised to balance me by March 2nd week, I didn't buy that idea but then, she was crying and begging seriously coz they have been served quit notice in their former apartment, due to this, we then made another agreement and I told her that, I won't hand over keys to the entire apartment, that I was going to let them have access to the kitchen key alone to gain access into the apartment pending when they will balance me my total money but I won't give them the sitting room key.
She said she had no problem with that and I made it known to her that, once they don't pay me the balance by March 2nd week and they start stressing me out in getting the balance, I will give them a few weeks grace and if they exhaust the grace period, I will take drastic action by entering into the apartment with the keys with me and lock it up while the 200k they paid will be non refundable cuz they have stayed in the apartment and used my things, she agreed and said since she has no intention of not paying then she's okay with that agreement and I gave them the kitchen keys and also introduced them to my landlord which he accepted they take over the apartment.


Now, I'm having serious issue with these people in paying my balance and I made it known to them on whatsapp that if by April ending, they don't pay me my balance, I will lock the apartment, they probably thought I was bluffing but I locked the apartment last week Friday and they went to police to report i couldn't let them have access to their things in the apartment.

My own decision right now, it has shown these people doesn't have that money to pay and I have decided to evict them from the apartment while the 200k they pay will not be refunded and when I told her my decision, she said I should return the money they paid and still give them time to look for another apartment before they move out then I asked her what will happen to the times you spent at my place and my things you have used in the apartment but she gave no response to that and was telling me either I return the money or I give them more time to pay me the balance.

Pls, how do I handle this.

Summary:
The apartment is a mini flat
The basic rent is 220k
I paid 340k as total rent
Spent over 450k to furnish, wiring and put few things inside
My rent started in Oct but gave it out in January
Ask them to continue the rent once mine due and pay 500k to own everything inside including my gen.


Pls advise me legally.

Take out your furniture. Let them have the accommodation. Stop compelling them to purchase your furnitures/fixtures/fittings/ whatever improvement you made in that flat. Its obvious they cant afford it any longer, but they have a right to the accommodation. Moreover it's a sublet you handed to them and the original agreement for the accommodation stipulates lease agreement/lease tenor is between you and your lessor. If they take you to court, you will loose woefully. Lick your wounds, count your losses and move on.

It's not that she doesn't want to pay you.The issue is that she doesn't have your balance right now.It may be she even borrowed money from a loan app to pay you.It is the same financial problem that you are having that majority of Nigerians are going through.If you are ok you won't sell you household items to her.To solve the equation remove your items inside and sell them to aboki that buys some of the used properties.

she should have cut her coat according to her size and leave my apartment to someone who have the financial muzzle to take it, she brought this on herself, I actually didn't leave the apartment cuz of financial issue, I left it cut of personal issue which wasn't finance and she jumped on it like someone who can afford it without thinking of her pocket.

Circumstances happen. Probably they wanted to initially but economic factors occured. This is obviously no fault of theirs. Like I am emphasizing again, the contract that joined yall is the 'accomodation' and not the furnishings. You put the furnishing there for your own interest. The lessee could claim that she was under duress. Since both of you have decided not to honour the agreement any longer, the options are that you eject from the property, calculate in % the amount they have enjoyed rentage vis a vis furnishing and pay them the balance or you remove your furnishing and allow them to enjoy the accommodation until the expiration of the tenancy agreement.. These are the best options you have for now.

Give them more time, it may not be convenient for you, but that will be the best approach now, probably both parties sign a written agreement at the police station or involve a lawyer if you can afford one.

Giving them time isn't an issue but what will happen if they fail to pay up again after another extra time given cuz, with the look of things, it doesn't look like they are capable of paying at all and I'm scared they sell off my things and move out from the apartment while I won't be able to locate them.

I've decided to put all my things in the room while I let them use the sitting room and kitchen for a certain period and if they don't pay me my balance within that period, I'm definitely taking legal action against them to move out of the apartment...


I would have moved out my things if I had a spacious place to put them, but I don't and reason why I want the new occupant to have it all and they are all new things.

That was the terms and conditions given before I hand over the key and they agreed to it.

I never forced it on them, I gave my terms and they felt comfortable with it.

You wey for sell your properties and anything that can't be sold you count it as your lost. Rent out the empty apartment. You don see where landlord they accept half payment as the first rent?

If she doesn't have the available now,why not plead/beg the owner to please exercise patient. Same way some useless criminals will borrowed money online and refused to pay back.

Better to just let go of the stuff as you don't need the things you left at the flat if not you are just stressing yourself

This is the bedroom furniture i left behind, brand new with the mattress and wardrobe.

Peoples houses have been flooded before and all the funiture destroyed all they have to do is to let go and move on. Just learn for next time that when you are making an agreement with someone and it involves money just know that there is a 99.99% chance they will not pay you the money back.
