Settings > Device > Software Updates. This will Check for New Updates, If your OS is up to date, You will be Notified else you will be Prompted to Update your OS

No to both questions
The hotspot uses a data plan not bis, on ur call credit

Ok, it will take close to 4-5 hours and your phone just have to be plugged on cos any interruption due to power/battery failure will affect the upgrade.
Furthermore, you ll not loose any of your files even bbm contacts

Is there any way i can trick my phone and carrier into allowing me to upgrade to OS 7.1?

Your 9800 CANNOT be upgraded to either OS7 or OS7.1

Updating through pressing the software update on your phone, is not the best option. Download blackberry desktop software on your computer, connect your phone to your computer via usb cable, make sure you have a BIS enabled sim card installed and you computer is online @ the point of update.
