My advice to APC is that this is a poisoned chalice that is sure to be pursued in higher Courts.

Use your adhoc delegates and proceed with your Convention. This overnight Kano judgement should be looked at critically.

I disagree with you completely. The judgement is in accordance with the constitution of the federal republic of Nigeria. The electoral act is subject to the constitution and the constitution already guaranteed the participation of statutory delegates in conventions like this. This is another poor job done by Ahmed lawan and co. I watched a lawyer explain this last week on TV. It's so clear that I was wondering if nobody knew about that section of the constitution.

As long as the convention has not taken place before the judgement it's still very implementable, the 7days submission of delegates list notwithstanding. This is a court judgement and INEC as a party is bound by it. We've seen INEC change names of candidates weeks to elections after the close of submission of candidate as a result of court orders and judgement.

However I think it's safer to proceed with the initial arrangement. But I won't be surprised if a restraining order of court against the party appears from nowhere on Monday saying don't conduct convention unless statutory delegates are allowed to vote. Fear Nigeria politicians oooooo.

INEC's letter to the Political Parties:
“In compliance with Article 4.5.1 of the INEC Regulations and Guidelines for the Conduct of Political Party Primaries, a political party that adopts the indirect primary mode, shall make available to the commission not later than seven days to the date of the primary, the list of persons that will form the delegates that are eligible to vote for nomination of the party candidate to contest every elective position.“
I disagree with you again fergie001. Don't forget that the seven days notice of submission of delegates list is just a mere guideline by INEC for operational purposes. You remember what the supreme court said in the case of Wike and dakuku peterside? Where the SC said a mere guideline by INEC can not supersede the provisions of the constitution of the federal republic of Nigeria as regards the use of smart card reader. It was after that judgement that the card reader was incorporated as law. That was how Wike escaped.

What are you even saying?? that APC should go and withdraw the list and submit a new one at this injury time?? You don't even know law. I'm 100% certain that if APC tries it, there would be multiple litigation against the party and INEC. The best is to go ahead with the convention.

No Court will issue that unless the President wants it.

I wanted to outline points that will will explain better but I think this place I quoted have settled it. The 1999 CFRN did not talk about Statutory Delegates, it is the APC and even PDP Constitutions that highlight same.

Again, INEC derives her powers from the Constitution and when not clashing with the 1999 CFRN or Electoral Act....they are in order. When you can challenge INEC's powers is where there is a clash, if there is none wrt the bolded, they are free.

This judgement is a mere academic exercise, because the event of the past has taken over the judgement already.

APC had already forwarded the list of delegates that will vote in the primary.

According to our electoral law, all political parties shall submit the list of delegates that will vote in any convention, not later than 7 days before the stipulated date.

S223 of the 1999 CFRN talks about the tenure of Principal Officers of Executive Committee like Wards, LGAs, etc. You can read it.
