Ndi Enugwu have chosen to be the fools of PDP. Even if the party brings out a frog, Enugu people will vote for it.

Why not try Frank Nweke Jr of APGA or the Labour Party candidate? Tufiakwa. Ihe a bu di ihe emere eme? undecided

I loathe the ebeano peeps. I have also gone through mba's manifesto and I believe he is chasing shadows. The young man has aggregated all the political vultures who are running this state down together and if they win, I just don't know where they will leave this state. We have seen the damage ugwuanyi did. Enugu needs someone to get the basics of governance right and build infrastructure. That is exactly what Sullivan did. I also think frank nweke might be the best developmental expert in enugu's political sphere and we would be lucky to have him. Having said that, no one can fault the pinnacle oil investment in Lekki. The man's business is oil lifting. That is the arena he plays in and he may just have built it's most important facility in Nigeria. You cannot build a tank farm in the south east because oil vessels don't berth here. It is purely business, he also has one in warri I believe.

PDP has falied us. Time to try another party. Vote for labour party. Look at the GDP of Enugu state and weep. The notorious Nrashi phenomenon has destroyed our economy
Do you people actually believe all these figures?

Why is Imo State so high up there?
What drives her economy?

The only economic stats I believe in Nigeria are IGR and federal allocations.
Re: Enugu, The Pride Of The East. by chinweze93(m): 1:40pm On Nov 11, 2022
I think while the figures might not be very accurate, it is a reflection of what is on ground. More urbanized states will have higher gdp. Enugu State has failed to drive expansion of urban areas including udi, oji river, awgu. Ninth mile is stuck in limbo. No major investment into the state in almost a decade. That Nsukka-Orba-Obollo afor axis should be subject to urban planning and aggressive development initiatives esp agro processing by the govt but here we are. I believe that new University should also have been stationed in nsukka to further drive urbanization. Onitsha and ebonyi are getting federal medical centers, our law makers are no where to be found. The bad ninth mile makurdi road has reduced economic activities in that area, something akin to tourism

Mbah's manifesto is just words without substance just like most Nigerian politician do...

I have heard Edeoga speak and give practical solutions to some of the problems bedeviling Enugu. The man is gaining huge grounds in the state... Everywhere and almost all radio stations are singing his jingles with callers vouching for him.

That's why PDP went to court to scuttle his chances but they will still fails.

I also heard edeoga speak and I was pleasantly surprised, however frank nweke is still way ahead for me in the way he has articulated our problems and how he will solve them. Also edeoga has not taken responsibility for his non-performance in Gburugburu's government which is a huge red flag for me. I listened to him say one can't blame enugu state govt for the state of refuse disposal because the population has increased. But that is the work of every govt, to find creative ways to use scarce resources, if they couldn't find competent persons to think out a solution, why are they even there?

Yes but didn't cancel it, they told them to reconduct the primary with the complainant to be in the ballot this time around. And should be conducted within 14 days.

The campaign spokesman said they is nothing to worry about that the judgment is not weighty. INEC has already published Edeoga is the flagbearer.

Judgement is not weighty? Lol. Isn't it better for them to be on the safe side & conduct a fresh primary?

Why we went to Court of Appeal – LP
16th November 2022

From Geoffrey Anyanwu, Enugu

Labour Party (LP) in Enugu state yesterday said that the ruling of the Federal High Court, Abuja ordering the repeat of its governorship primary, contradicted the spirit of the Constitution and the Electoral Act.

The party said it was on that premise that it decided to appeal against the judgment which it also faulted on nine grounds.

It also alleged that the development was orchestrated to slow down its efforts to win the 2023 elections in the state, accusing the ruling Peoples Democratic Party (PDP) in the state of being behind it.

Last week the Abuja Court had nullified the governorship primary that produced Hon. Chijioke Edeoga as the party’s candidate holding that the plaintiff, Evaristus Nnaji was sidelined from the contest and asked the Independent National Electoral Commission (INEC) to conduct the repeat primary within 14 days from the date of the ruling.

But the State LP accused PDP of using its surrogates in the guise of members of the party to institute actions against its candidates, so as to dwarf its campaigns, insisting that there was no going back in dethroning the party in the 2023 elections.

The Senatorial candidate of the party for Enugu North, Chief Okey Ezea, who addressed newsmen said that the appeal was necessitated by the gaps in the ruling, insisting that there was no basis for the decision the court took.

According to Ezea who is also a lawyer, the court allowed itself to be drawn into a matter that ordinarily negated the spirit of the electoral act, noting that Edeoga who was the product of the annulled primary was not listed in the case.

He said, “In the case of Evaristus Nnaji against Labour Party and INEC, Nnaji first went to the Federal High Court, Port Harcourt and sued Labour Party and INEC and Chijioke Edeoga as the third respondent and he tried to obtain exparte order against the parties. But when it was not possible, he filed a notice of discontinuance and we thought that was the end of the matter. We didn’t hear anything again until the Labour Party headquarters was served with originating summons.

“This time around, he didn’t join Chijioke Edeoga. He sued only the Labour Party and INEC. And in his case, he told the court that he paid the Labour Party to be made the sole governorship candidate in Enugu state and this was after Edeoga had emerged.

“He alleged that Labour Party officials collected N25m from him under the illegal agreement to make him the sole candidate in the election. But as we know in law, this is an illegal contract and no court of law with competent jurisdiction will be asked to enforce an illegal contract. It is a contract against public policy because there is no provision of the electoral act where you can contract with party officials to be made a sole candidate.

“Not only that, he did not join the gubernatorial candidate of the Labour Party who had earlier emerged and his name forwarded to INEC on the 4th of August. Giving the principle of law, a court cannot give an order that should affect a party that was not represented in the proceedings. Not only that, the Federal High Court practice direction 2022, paragraph three, stipulates that anybody who is filing an election matter must join the person who won that primary, whose name has been transferred to INEC. So Chijioke Edeoga who won that primary and whose name has been transferred to INEC under that paragraph should have been joined. So the court gave an order against his primary election without hearing from him. It is against the rule under section 31 of the 1999 constitution as amended.

Noting that INEC was fully represented during the primary that produced Edeoga, and the report of the officials of the commission on the conduct of the exercise was there for anyone to see he said, “We have appealed. We developed nine grounds of appeal. We said the court erred in law by holding that Nnaji is an aspirant. We also said that the court erred in law by not holding that the action was incompetent having not joined necessary parties in the matter.”

They will be no fresh primaries... Have another primaries is akin to playing to the tune of PDP because they will hijack it.

Court Judgement: Edeoga remains Enugu guber candidate, no fresh primary – Labour Party

Published on November 16, 2022 By Emmanuel Uzodinma

The Labour Party has declared that Hon. Barr. Chijioke Edeoga remains its governorship candidate in Enugu State.

The Party took the stand on Wednesday during a stakeholders’ meeting held in Enugu, the Coal City Capital.

DAILY POST reports that a Federal High Court sitting in Abuja had ordered a fresh primary election within 14 days.

The ruling was in respect of a suit filed by Capt. Everest Nnaji, who claimed he was wrongfully excluded during the primary election that produced Edeoga.

However, at the meeting, the stakeholders said they have considered all the issues involved and decided that there was no need for a fresh primary election.

Addressing journalists after the meeting, the Senatorial Candidate of the Labour Party for Enugu North Senatorial Zone, Barr. Okey Ezea said the party had already appealed the judgement.

He described the court ruling as a contrived judgement that cannot stand before an appellate court.

Ezea said, “I’m very conversant with the legal tussle on the guber election between Everest Nnaji and INEC. As far as we are concerned, the dispute is not intra-party but the PDP against the Labour Party.

“It is the PDP in Enugu State against the Labour Party; the PDP is using some surrogates who are doing the bidding of the ruling party.”

On the facts of the matter, he said Odengene (Nnaji) first went to Federal High Court Port Harcourt and sued the Labour Party, INEC, Edeoga. He wanted an ex-parte but failed, he later withdrew the matter.

“We didn’t hear from him again until he came again by originating summon in another Federal High Court in Abuja. He claimed he met the Labour Party and gave them N25m to be made sole candidate, under illegal agreement.

“As we know in law, this is an illegal contract and no court can enforce such an illegal contract.

“Not only that, he did not join the guber candidate, Edeoga, who had earlier emerged on the 4th of August.”

Ezea faulted the court judgement, as according to him, “A law court cannot give an order that will affect a party that was not represented.

“The Federal High Court Practice Direction states that any person filing pre-election matters must join the person whose name had been submitted to INEC. You are bringing an order of court nullifying his primary when he was not heard.

“Even the Supreme Court has affirmed that it is also only an aspirant that can file a pre-election matter.

“By this definition, Odengene was not even an aspirant. He did not even buy a form. It is Odengene Aviation Services Ltd. that bought form. I’m not even sure his name is on the party’s register. So, he has no locus to bring the matter at all.

“He claimed he was not informed of the date of the primary. We want to know which part of the Electoral Act he is relying upon to make such claims.”

On why the party would not conduct a fresh primary, Ezea, popularly known as Ideke said, “It will be wrong for us to play into their hands when we had a genuine primary election monitored by over 10 INEC officials, with their report clearly written.

“We have no reason to succumb to the shenanigans of the PDP and their cohorts.

“The next plan is that we have appealed, nine grounds of appeal. Our stand is that the court erred in law by holding that Odengene is an aspirant.

“We also said that the court erred in law by not holding that the action was incompetent by not joining the necessary parties.

“We also said the court erred in law by putting itself to enforce an illegal contract.”

He called on the party’s supporters to continue their campaigns unhindered as there was no encumbrance against such.

“Electoral matters terminate at the Supreme Court so there is nothing stopping Edeoga’s campaign. There is nothing to worry about. We have appealed and in election matters, appeal stops execution.

“Edeoga remains the Labour Party candidate. He will not be falling foul of the law. He remains the candidate of the Labour Party until the court process is exhausted.”

Meanwhile, Ezea has dismissed claims that he forged the signature of a Labour Party senatorial aspirant for Enugu North Senatorial District, Mr. Ernest Ike Ugwu.

While accusing Ugwu of committing criminal defamation, Ezea said it was aimed at distracting him from the race.

“Ike Ugwu that goes about shouting my name, it is clear criminal defamation. Ike Ugwu did not join my name not on that court matter. If you knew I forged your signature, why didn’t you join me in the suit?

“Ike Ugwu cannot contest councillorship election in Obukpa ward, that’s the same person that stays at NICON and has two SANs appealing for him. They are in panic mode but we will defeat them,” he further stated.
