His character may have been questionable before this incidence for him to have been a suspect.

I always tell people, your integrity in all situation should be able to set you apart. There are things that would happen in an organization and there are certain kind of people that would never be fingered or assumed culpable. But there are certainly that group of people/person that are usually viewed with suspicion. He may have been part of the later.

since the MD has invited him to his office and apologized him, after finding out the truth that its an accounting error, there is no need to sue the company. Thank God the missing money was not stolen, let him settle out of court. Put what has happened behind, be positive and move on.

He was a director and never realized until God show him , that's if he really understand .

Out of court or out of shrine , whatever i will claim from them will be enough to establish my own business ... that am sure of !

If not for the corrupt judicial system we have, suing the MD and the company would have been the best option. But now, I don't even know what to advice. But believe me, ehen, I would sue them for defamation of character, false accusations, unlawful detention, future attempt to my life (because they'll surely try to silence him one way or the other), etc.

They should settle out of court, coz this is Nigeria, he might sue them and the case will linger for ages, even if he wins, they might still delay the payment. Except he has nothing to lose

He can sue the company but the Judge will review the case and efforts made by the company, including the apologies and then issue a judgment that may no favor him. It’s best to reach an amicable settlement in order to avoid waste of resources by both parties.

Court case is always 50/50... He might win or lose, no matter the facts..

Besides, we just have his own side of the story.. There are always 3 sides to a story.. The complainant's side, the Suspect's side, and the truth.. And it is almost always unlikely that any of the parties involved is saying the whole truth.

A good lawyer for the company can so upturn the facts that he might end up having damages awarded against him in favor of the company

Courts don't care what really happened.. It's only concerned with what can be proved before it..

He should accept the settlement and rest.. As an individual, it's even very unlikely he has the financial warchest to litigate with a Company.. Company wey just to frustrate am, dem go drag case for years, even reach Supreme Court.
these are some of the many reasons the country is not progressing... ignorance and fear of the unknown....

Upon resumption, he was invited to the MD's office for an apology as their investigation showed the money was not stolen but the proper account was not done.

Now, he wants to sue the organization for unfair treatment and they are pleading for a settlement outside the court.
Pls I beg you to plead with him to sue them. Let him not settle out of court o because they were ready to do same to him without proper investigation.
They never showed mercy so the company doest deserve one. He will be more compensated when the matter gets to court and will serve as a lesson to other people like the yeye MD

THE COMPANY LAWYERS WOULD FIGHT TOOTH AND NAIL AND WHOEVER IS MORE POWERFUL IS LIKELY TO WIN. THE ODDS ARE NOT IN HIS FAVOUR AND DEPENDING ON LUCK IN THIS HARD TIMES IS NOT A SMART IDEA. Well, this is a very simple case. Listen to my advice. It is the best solution for him. He needs to get a lawyer immediately.

Most people use where they have worked as referrals. Even if you do not use where you have worked as a referral, you do add it to your CV under working experience. Some recruiters reach out to past employers to make inquiries about the candidate.

Let him get a lawyer. The MD should write an official apology letter. Stamp and signed in the company letterhead. In the letter, the MD should clearly state that he would give honest and good feedback about the boy's honesty if ever he is asked. If need be, get an order refraining him from speaking bad about the boy. Any act to speak bad about the boy will be taken as outright defamation of character.

Why do I say this? The boy might just accept an apology from the mouth of the MD and he stops working there. If a new employer calls the MD to make inquiries about the boy, you would be shocked at what the MD might say. Some Nigerians are very very wicked. He would tell them the boy stole from him. And that will be the end of the boy's chances in the new place of work.

Let him get a lawyer. He needs a written apology. He needs the MD to put in writing that he would refrain completely from defaming the boy's character henceforth.

All to be be said has been said by by those who dropped comments before mine, but if it were to be me, I would sue the company thereby making them as reference to other companies who just do thing because they assume they have an edge.

After two weeks? Hope you know that some wrongfully accused persons die in cells within this period and case gets buried even after finding out the truth.

This was sooo cruel of the management; passing judgement without any evidence. Ensure your sue, or else they will accuse you falsely again and again. Sue & damn any consequence like loosing your job. It's not even a healthy place to work.
