An executive order does not go through the legislature. And executive order is an emergency decree by the president. If the decree is not constitutional the judiciary can strike it down. If the legislature disagrees they can strike it down by way of holding a vote against it. But most of the time, executive orders are not opposed because the executive branch is partly there to make fast pace decisions. Since the constitution is the supreme law of the land, the constitution is what these decrees have to abide by.

not all laws are executive orders, and not all presidental initatives are executive orders.
