Not sure the position of INEC with respect to the constitution, but the Kogi election that brought in Yahaya Bello was as a result of Audu's death (winner of the Gubernatorial elections).
His running mate, I think Faleke was not even considered to take over, rather,they chose Bello who was the runner up in the State primaries

No, this is not correct. The vice president can only be sworn in as president if they, that is the president (that dies) and the vice have been sworn in (29/05).

If a president elect dies, the runner-up in the party presidential primaries becomes the president automatically. Abubakar Audu of Kogi state is classic example.
