The appeal court cannot override or ignore the law.

The law says candidates must be registered members of a political party. Proof of membership is taken from the register of members that a party submits to INEC shortly before the election.

The man's name was not in NNPP's register. Who is a registered member of a political party? If I joined few days before an election, what am I?

What do you expect the court to do. Ignore the law?

I don't know why many Nigerians are Soo sentimental and Insulting the Judiciary for doing their Job. Nigeria politicians are so desperate . The Constitution is there for all to read. If you are not well nominated by a political party you can't become legal confidante. What many Nigerians are doing to judiciary is bad in the name of politics . Yet if they feel cheated they will still rush back to the same Judiciary. The Judiciary is meant to interpret the law where there is conflict of interest why are you insulting them when what they interpreted is still in the book of constitution?

oga, supreme court have overruled that, as long as there is no division in the party and members agreed you are their candidate, case closed.

You can confirm.

The SC sits in 7 especially on Constitutional matters. No matter how wrong or bizarre that judgement is, for it to be vacated, they must sit in 7. It's a conventional procedure.

The Appeal Court can also sit in 5 if it's a Constitutional matter as well like in Jegede v. Aketi.

Here is what the law says as regards ballot papers not signed and stamped


"(1) Subject to subsection (2), a ballot paper which does not bear
official mark prescribed by the Commission shall not be counted.
(2) If the returning officer is satisfied that a ballot paper which does not
bear the official mark was from a book of ballot papers which was furnished
to the presiding officer of the polling unit in which the vote was cast for use at
the election in question, he or she shall, notwithstanding the absence of the
official mark, count that ballot paper".

From the above, the law provided a leeway to the issue of unsigned and unstamped ballot papers.
The argument to this will surely happened in the court before reaching a judgement, but believe me, for all the unsigned or stamped ballots to be for only a party and not any other party means a lot
