Is FRSC Breaking Law ? by MT(op): 4:56pm On Dec 15, 2023
Despite the Appeal Court reaffirming the earlier judgement of the High Court that FRSC should ONLY operate on a federal road, will FRSC be breaking law if seen on state roads?

I asked because I saw them in different places on the state roads still operating, extorting and harassing motorists.

Also, is FRSC right to fine motorists for having a faded plate number, knowing fully well that they were responsible for issuing sub standards plate number to motorists.

I have seen lot of people fined on this.

Lawyers in the house, over to you

We are talking of the position of the law.

Also, each state has their own state agency performing the same function as FRSC on state roads.

Are you saying FRSC has the legal right to ignore the High Court and Appeal Court judgement telling them to focus on Federal roads only?

That would be on humanitarian ground...even ordinary people do help to rescue accident victims anywhere it happens...so it no good example and doesn't count in this situation....!!

The laws of Nigeria are meant for some people not for everyone

Exactly!

One day, someone will take that agency to court if fined on a non federal road, and FRSC will have an issue in their hands

They are normalizing illegality because people just pay the fine and roll with it because they do not want to go through the process of litigation.

Stop justifying illegality! FRSC officials don't have to stand on state roads before they can rescue accident victims on state roads. If there's a law prohibiting them from staying there then they should only appear when there's an emergency.

I came on a visit to Nigeria and witnessed it firsthand.

I was not the one even driving.

The FRSC checked the vehicle I was in, everything was in tact but said his plate number was faded, and he would be fined for that. It happened on a State road.

At that time the driver challenged them they were not meant to be on the state road based on the judgement of the High Court and Appeal Court.

Yet they still fined him 3,000 Naira for having faded plate number.

So I wonder why there has been no one that challenged the FRSC in court, based on the earlier court judgement.

If this was to happen in the US, people would make a lot of claims.
