Court Orders EFCC To Pay Emefiele N100m Over Fundamental Rights Violation by chokekachy(op): 5:16pm On Jan 08, 2024
Justice Olukayode Adeniyi of an FCT High Court on Monday awarded N100 million in damages to suspended former governor of the central bank of Nigeria, CBN, against the federal government and Economic and financial Crimes Commission, EFCC, for violations of his rights.

The embattled Emefiele had dragged the Federal Government, Attorney-General of the Federation, AGF, EFCC to enforce his fundamental rights to life, personal liberty, fair hearing and freedom of movement.

Mr Emefiele sought a declaration of the court that his continued detention by the agency of the first and second respondents since June 10, 2023 and subsequent transfer to the custody of the third and fourth respondents on October 26, 2023 without being arraigned in court is unlawful.

He said the respondents in deviance of several valid subsisting court orders for his release amounts to a grave violation of his fundamental rights to life, personal liberty, as guaranteed by the 1999 Constitution of Nigeria (as amended) and the African Charter on Human and Peoples’ Rights.

He, therefore, among others sought an injunction restraining the respondents from further arresting and or further detaining him up on his release by the court without proffering a criminal charge against him.

He also sought damages of N1 billion in his favour for the violation of his fundamental rights.

I don't know why security agencies love human rights violations. Disobeying court orders, and will still want the same court to convict the same person

If you listen to the propaganda from Lagos-Ibadan expressway, you'd think Emefiele was responsible for all the evil of APC's government.

The court has given a judgement. We have seen this drama before with Dasuki, Tinubu following Bubu's footsteps verbatim!

The Court is right.
He was hounded, his house surrounded and he was picked up and ferried to Abuja from Lagos without charges. The right thing to do was invite him like they have done Edu, Farouq, etc.

4 out of 5 times, FG agencies won't pay the money and even if they appeal the judgement, it will always fail.

Nnamdi Kanu despite his terrorism charges still won a rights violation suit at the Federal High Court with the manner the soldiers attacked his country-home.

You should be more concerned with security agencies going after the corrupt politicians using the right means. You hear of this because the one in question is a prominent man that could afford legal fees.
Security agencies while conducting their business do this and even far worse to ordinary people.

They can go after corrupt people and still do it the right way. Going after corrupt people is not an excuse for violation
