There is a supreme Court precedent as regards this and division is only recognized when their is division in the National working committee and not division in the state chapter. Example parallel NWC of the party in the national level is a good grounds for defection without loosing their seats but division in the state chapter doesn't affect the running of the party at the center.

Rivers people voted massively for PDP during the Guber/HOA elections.

For the Presidential election, we were divided between Obi and Asiwaju. Atiku was the third choice.

In the presidential election we were not divided we voted massively for LP , if you have access to the original sheets emanating from the pooling units you will understand this but in the HoA PDP took everything because of the voter apathy and the threats for people not to come out to vote, PDP won massively in that elections.

You're talking like this is the first time Nigerian politicians have defected.

For whatever isn’t explicitly mentioned in the constitution, courts use precedents to pass judgment. And on this matter there is ample precedent.
