I like this quote u hit the nail at the head, they are going to supreme court to appeal for jurisdition so if supreme court afairm FHC judgement on this, they will file a case again at the FHC starting afresh before it gets to supreme court three years don go. hmm

The ealier Fubara understands that Tinubu is not his father, the better for him. All this father of nation talk here and there is bullshit. Tinubu as a state governor fought Obasanjo (a general) to a standstill. Fubara should man up and face the real people fighting him. Tinubu will never side him, that will never happen.

you see I do say it , the constitution is one the problem of Nigeria. There are process in becoming a member of a party and also a process is resigning your membership of that party constitutionally. Now let me quickly highlights some of the process in resigning. 1 you must write a latter to your Ward chairman 2 you must submit your membership card 3 you must tell the public showing your resignation latter signed by your Ward chairman 4 your name will remove from the party register. court work with what is in constitution. All what I listed the lawmakers did not do any of them , by guild line of the constitution they are still members of PDP. None of them have APC membership card, none of them were registered in there ward as APC member. All of them still have PDP membership card and all of them names are still in PDP register
Okay, so I guess it's left for them to now come out boldly and state that they are still in PDP even though they already did what they did. Interesting days ahead.

Pursuant to section 68(1)(g) of the 1999 Constitution (as amended) which expressly prohibits cross carpeting by legislators and provides for circumstance(s) in which legitimate defection is permissible. In the case of Abegunde v. Ondo State House of Assembly (2014) LPELR 23683, the Supreme Court rejected the argument of the appellant, a member of the House of Representatives who decamped from Labour Party to Action Congress of Nigeria (ACN) on the basis of fractionalization of the party at the State level. The Supreme Court held that only a division that makes it impossible for a party to function can provide the basis for a legislator’s defection hence, the Appellant’s seat was declared vacant.
