Some states are fighting hard to silence the LG and erode their power. Yet, this all point to the need to devolve fiscal control from the federation back to the regions and the states under them so that,, like in the first republic, each region can then run its government with a unique constitution basically tailored for it.
Federal government meddling in state affairs shouldn't be encouraged in any form, despite the NEED TO LIBERATE THE LG FROM THE STATE's SHACKLE.

No matter how good or bad, law is what judges say law is. The Supreme Court Judges have spoken and anyone not satisfied should appeal to God.

He raised very valid points here. I do not understand what the judgement had to say about Section 162 (3). Has the Supreme Court set aside that Section or repealed it?
Most times the supreme court does not rule according to established laws,but justice. In this case, it is justified and morally acceptable to allow the local govts have their funds directly since governors have misused the priority given to them.

Tinubu want to control the Local governments directly from Abuja.

He can do away with the Governor of the state if he has all the LG chairmen under his control.

This will surely backfire against him.

We should go back to REGIONAL GOVERNMENT if we want to suceed as a nation.

Because of this corruption, they refused to conduct election at the local government level. If they were not diverting and stealing local government allocations, there wouldn't be this judgement or taking each other to court. Thieves

This judgement is about Rivers state and those states where baba no win for 2023. Even the creation of new states too. He is making moves for 2027 now and the opposition are sleeping... later they will start crying when results come out

The spirit of the law is only important when there is ambiguity and/or ambivalence in the letter of the law but this is not the case.

The constitution is clear and any interpretation that contradicts the clear letter of the law is an usurpation of power from the legislature by the supreme court.

The judiciary should interpret the law and not make laws. If we are dissatisfied with the current laws, then the constitution and/or laws should be amended by the legislature.

In the presidential system of government, there are 3 arms of government with distinct non-overlapping roles, but in the Nigerian version, there is only one arm with two fingers undecided

I didn't support subsidy removal under Jonathan and Tinubu. I didn't support floating of naira either. But I'm in support of removing govs access to local govt allocations because they are diverting these money and development at the local govt level is non existent

The messager may be faulty but the message is right, the Supreme Court has started legislating from the bench. So what stops the south east governors from going to the Supreme Court to ask for another state in the south east to be at par with other regions? Local government antonomy is good, the way they went about it may set a dangerous precedent in future.

LGs are not indepedent from the states. The constitution puts them under the administration of the states. Go and read section 7 very well.
That does not mean you can't hold them accountable BUT they are under the administration of the state.

Two wrongs do not make a right. The SC clearly committed an abomination by summarily taking over the responsibility of the legislature
The fact still remains that the LGs by our law are supposed to be funded from the state account and not directly from the federal account. The full ramifications of this misnomer will be seen soon. It is now too obvious that our judiciary is dancing to some peculiar tunes. This has never happened in the history of our country that the judiciary will be amending the constitution

Honestly, as for me this is an achievement on this supreme court ruling today.

Believe me on this, many will relocate to their local governments for a better life because local government is the closest and only tier of government closer to the masses. Enough of the arrogant and political robbers called state governors sitting in there rooms and be removing local government chairmen anyhow while president can't sit in Abuja and remove state governors. I clap for baba daada Prince Lateef Fagbemi ( SAN) on this good news unlike that brown teethed charge and bail looked like former attorney general called malami.

State and Local Government operate a joint account. The essence of the State and Local Government Joint Account is for the purpose of the state paying 10% of its IGR to the various Local Government in the state.

So with this ruling, does it mean that the 10% will no longer be accruable to the Local government?

This are the conversation we should be xraying
So the governors cannot pay the 10% of the igr to the lgas account again even if it's not in a joint account? How does this sound

Well, but why are our governors so selfish?? Some community never gets government touch since 1999 and yet, no sympathy for them. This might caused fights btw governor and FG and can affect Thier support for Tinubu in 2027 but , with massive grassroot development he will have LG support.
