A State High Court in Port Harcourt has restrained Tony Okocha and other members of the caretaker committee of the APC, appointed by the party's National Working Committee, from presenting themselves as the committee's chairman and members in Rivers State.

The Court also restrained them from taking any action or interfering in the affairs of the APC State Executive led by Emeka Beke until the expiration of their four-year tenure.

The presiding Judge, Justice Sika Aprioku, in his judgement, held that the appointment of Tony Okocha and six others as State APC Chairman and Caretaker Committee members is in disobedience of the party constitution. He said there was no situation in the party to warrant their dissolution. The judge also awarded a N300,000 cost against the defendants.

Who told you that, but someone can take an injunction not to be suspended from a party, Emeka beke has a case you can't remove because he was elected for 4 yrs and should be allowed to complete his tenure, you can't just remove and say it's a party issue the courts has the jurisdiction to protect him.

Sate high court has no jurisdiction to hear this. Fubara trying to split APC.

Fubara should not go there ooo,he has not been to finish the fight in PDP he wants to add APC to his fight. He should better withdraw from this fight. Tony is not a gentleman.

Beke is anti-Wike & pro-Amaechi.

However, this will not stand the scrutiny of higher Courts because leadership tussle within parties are strictly INTERNAL AFFAIRS of a political party and the Court simply has no jurisdiction.

The judgement is afflicted with jurisdictional issues and has no chance of survival, in short, it is bound to fail but for now it stands.

Before the end of the week, another court of coordinate jurisdiction in Abuja will order Tony Okocha to go back to office.
An Abuja Federal High court which is equal to this court will give this judgement.
