Expert View: As Supreme Court Poised to Rule on Constitutionality of Key Acts in Kogi AG and 16 others v. AGF Case


What are the Legal Issues and the Confidence of Nigerians that the Supreme Court of Nigeria will Do Justice in the Suit Filed by Kogi State AG and 16 Others v. AGF on the Constitutionality or Validity of Certain Acts Challenged in that Suit?

The above-mentioned suit came before the Supreme Court of Nigeria on the 8th of October, 2024, and was adjourned to the 22nd of October, 2024, for hearing.

Pundits are confident that, in view of the clear position of the law on the issues brought before the Supreme Court in the said suit by the AGs of the states v. the AGF, and coupled with the declared commitment of the current head of the judiciary, Hon. Justice Kudirat Kekere-Ekun, to ensure the independence and integrity of the judiciary, the right decision will be made under the circumstances of the suit.

This would lend credence to the doctrine of true federalism, respect for the rule of law, and constitutional order. The time-honored principle in *Macfoy v. UAC* is still relevant, to the extent that if the law provides for a mandatory way to perform an action, and one fails in that regard, the failure renders the action a nullity, as one cannot build something on nothing.

In other words, the Supreme Court found in *Nwobike’s Case* that the Acts challenged in the suit, particularly the EFCC Act, were rooted in a UN Convention. By virtue of Section 12 of the 1999 Constitution, the states of the federation, as critical stakeholders in Nigeria, were supposed to be consulted or involved in enacting those Acts, but that did not happen.

This is the reason why those Acts are considered unconstitutional, and the Supreme Court is being called upon to so hold and accordingly nullify them.

It is also the position that the items that gave rise to those Acts were not on the exclusive legislative list, meaning that the National Assembly could not make laws on them without consulting the states of the federation. Indeed, the defendant in the suit did not dispute these facts but simply posited that the concurrence of the states was not needed or required in enacting those Acts. This is a very wrong and misconceived position.

The Supreme Court of Nigeria is therefore called upon to rise to the occasion, assert its uprightness, integrity, and supremacy, by doing what is right in this matter—just as it did in the Naira redesign suit, which involved similar principles to the instant case.

Infact, another agency should be created and EFCC, ICPC , NFIU scrapped out.

How can a commission created to fight corruption, now becomes the architect of corruption, helping corrupt politicians and rich folks to enshrine in more corruption.

In the case of Bobrisky, EFCC denying the fact that they dropped the money laundering charge against him is simply a safe-face tactic. Their best option is to investigate and ring down the officer to make Nigerians place their hopes on them.

States challenging this is a good course, for a nation like Nigeria, the fact that a body like ICPC of EFCC which are under control of the presidency and higher powers can investigate anyone they have interest in, is of great concern.

I will take it good when the law also includes all citizens of the states, I mean why would EFCC not be able to investigate the first citizen of a state(the governor) and all his cabinet but will enter the same state and harass citizens..

That will encourage mad corruption and more oppression on the the citizens, for me what will help is for the all the anti corruption agencies including the police to be moved under the judiciary and the judiciary should be completely independent from the executive, from appointments and salary to funding, they should be tied and managed by the NBA with electoral process for appointment of judges from the NBA which covers all practicing lawyers in Nigeria which will be done just like we have normal elections in Nigeria with jurisdictions but strictly for lawyers to vote only...

Because as long as most of these present politicians in power control these agencies, forget it.

The AG should ask for State Police first as EFCC is an off shoot of Federal Police.

Stopping them from acting is like stop a Police from Arresting a State Government Vehicle for braking the traffic rule.

The issue here is who take the process of recovered money not how to shield the suspect

Hmmm... I don't think FG's EFCC has the right to probe states accounts under the Federation.

However, if Kogi and others succeed in this suit, corruption in states will be out of this world more than we currently have it.

Did Bob committed the Money Laundering offence? His/her offence was Naira Abuse cos he sprayed naira notes at a party. How does that becomes money laundering? Infact the EFCC spokesperson said, the money laundering charge was never part of his charge at any point, so the question of when it was removed was inappropriate.

Yea, not just scrapping the power of the EFCC etc. but let's practice fiscal federalism. Each State can decide how they want their funds spent. This ongoing pilfering of funds is because they don't contribute much to get monthly allocations.

Something cannot stand on nothing bros. The EFCC Act as passed is unconstitutional. Yes it is sad given that Bello is trying to escape justice but the law is the law. Besides it is still the general job of the police to prosecute Bello in any case.

You people are something else. the EFCC has said times without number that the money laundry case was thrown out for lack of substantial eveidence are you lots are here talking trash. for your info someone into money laundry that cannot pay for N4,000.000 debt. you should know that these states governors are the most corrupt entity in Nigeria. and corruption will always fight back.

In other words, it is time to kill that pesky EFCC that has been disturbing looting politicians especially governors. Once EFCC is killed, there is no fear for our politicians to loot as much as possible anymore as the road is now free

Everybody should note that the Op and the first two monikers to comment on this platform are pro-Bello accounts probably created by his minions. In other words, 16 states are asking the Supreme Court to kill EFCC all because of Bello

For all those who may not know, EFCC was created by the OBJ administration because the US and other Western lenders to Nigeria showed OBJ the amount of graft that had taken place since democracy was installed in 1999 especially money laundering. Governors then were brazenly moving truckloads of dollars to foreign countries in contravention of Anti-Money laundering laws of those countries. This led the Western countries to insist that Nigeria cannot get debt forgiveness unless we clean our house which had become worse in terms of laundering of money more than even the Abacha period. This is the summary of what birthed EFCC in 2003. Countries such as the US, UK and Netherlands helped Nigeria to set up EFCC by training and providing equipment and even funds to ensure its setup and smooth operation. As a matter of fact, EFCC was supposed to be a department under the police but since even the police was fingered in the corruption, it had to be separated and given a hair of autonomy.

This is where we are in Nigeria now. Instead of finetuning EFCC to give it more bite and ability to fight financial crimes, 16 governors are looking to kill EFCC. This is happening under an administration that claims to be looking for foreign investors. If this happens, Nigerians can be assured that corruption will rise to over 100% as there will be no one to check all these politicians for money laundering anymore.
