There's no dilemma. The Judiciary is independent and doing its job. The prosecution has opposed the oral application and may have petitioned against the transfer of the case because it will further elongate the criminal case against the spirit of the quick administration of criminal justice rule.

The good news is that he is being given an unfettered opportunity to defend himself, if he doesn't avail himself of the opportunity, the court system will not turn itself into a circus to entertain.

I expect that by now his legal team must start preparing the motion and make a formal application with supporting documents and evidence before it's now argued before the Judge and the judge may now rule on the application. If the prosecution were able to sufficiently convince the court then his application will be rejected but if not then the Judge may now uphold the application before returning the file to the Chief Judge who may now reassign the criminal case.
