Hello guys, happy sunday to you all.

Quick one, I would like to know your thoughts concerning an issue in an apartment I rented here in Abuja early this year. It is a 2 bedroom , live-alone apartment (just my family) on a half plot of land with some bananas in front of it.

A couple of weeks ago, the landlord and caretaker called me to tell me that they wanted to send someone to come and check if the bananas are ripe for them to come and harvest it, which I vehemently refused.

Property Lawyers in the house and well-meaning Nairalanders, kindly advise on this situation before it escalates. I believe it is my right to have exclusive or sole possession of the property so long as my rent is still active. What's your take on this please? Am I wrong ? My children take care of these trees daily by watering and clearing the place. I feel this is wrong from the landlord to do that.

Sorry for the long write-up. Please advise

All these do not make you the owner. The landlord planted the bananas.

You only rented a 2bedroom flat, you did not rent the trees around it.

If I'm the landlord, I'll arrest you for trespassing and theft.

You are not the owner of the banana...it belong to your landlord...it is his land...he planted it there...you only rented an apartment there does not make u the owner...

Op you go like problem oh😂.
The banana is not yours abeg….you only paid for the apartment.
It just like saying that your landlord can not develop the empty space in your compound(that’s if there is any) because you paid for an apartment.

I think you are being naive here. You should have asked who planted it. The last occupant did. Don't jump into conclusion please. You are obviously not a lawyer and your input isn't needed. I just want to know what the law says about that and not your own conclusion. Thank you

Oliver De Coque once sang that "flowers you planted in a rented house isn't yours when you're moving out of the house" not to talk of the one you didn't plant. Pls leave your landlord's banana alone, there is a reason why it is called economic tree, except if it was contained in your agreement as exclusively yours.

Thank God I am not the musician Oliver De Coque. I can't be taking care of the place , removing weeds and all, watering and cultivating etc and then someone comes to collect everything when it is time for harvest. Only a fool or someone very naive will do that sir

grin grin grin. Nor reason am jare. It didn't happen to me per se but a female friend in Abuja. I advised her to seek the advice of a legal counsel since she signed an agreement with the landlord before renting the place that she would "solely" be in charge of taking care of the place, repairs and all and the landlord can only come for inspection. After like 8 to 9 months of her hard labour calling aboki and labourers to work on the land she is using for farming, someone will now come and say because it is his land, the harvest is his. That's not legal na. What happens to the time, money and effort she has put in ? I just feel the landlord is very greedy. This is just one tree holding just one bunch of banana and some tomatoes , pawpaw and pepper she planted. Why is he adamant on just the bananas ? Why didn't he talk about the tomatoes and pepper ? This is also very wrong. I expected him to ask to share it and not claim it to be his alone

I wanted to suggest your last paragraph but thank God you already mentioned it. Advice her to share harvest with landlord. In Naija constitution if you plant an Economic tree on a man's land he doesn't have right to clear it just like that without compensation and likewise its expected you pay for the plot for the period of your planting if the landlord request. So you see its a 50/50 thing.

NB: Gbagyi man no dey joke with his economic tree ooo. Them dey even fight government. They can go diabolical,

My brother from the pics you uploaded there ...you are talking about quit notice and permission.....here the landlord and caretaker have informed you already f...kind of permission..hence the notification.

You said the former tenant planted the banana...and it is only the former tenant that have right to come and pluck or harvest it...but since the former tenant is not available anymore...the banana belongs to your landlord as it is his land the banana was planted on...

In the nutshell the former tenant self need permission from the landlord to plant the banana there in the first place...

This is an easy issue. The truth is as bright as day. Did you plant the Banana? If you did not, please allow them harvest as they wish. You should only hope they give you from the harvest.
