LG Autonomy Will Lead to Chaos – Anambra Governor Soludo Signs Bill to Deduct Funds | #Politicsnigeria

Anambra State Governor, Prof. Chukwuma Soludo, has said that granting full autonomy to Nigeria’s 774 local government areas could lead to “humongous chaos” and hinder sustainable development.

Governor Soludo made this statement on Tuesday at the Governor’s Lodge in Amawbia, Awka, after signing the Anambra State Local Government Administration Law, titled “Anambra Local Government Administration Law 2024.”

The law was passed by the State House of Assembly last Thursday.

Soludo argued that absolute autonomy for local government areas is impossible and would create chaos due to the attendant challenges. He said that Section 7 of the constitution empowers state governments to enact laws for local government administration, highlighting the importance of state oversight.

“The absolute autonomy to the 774 local government areas in the country is an impossibility,” Soludo said. “In fact, it is a recipe for humongous chaos. The attendant challenges before the issue of local government autonomy are such that would certainly deepen the fate of the system and spell doom for the expected beneficiaries of the process if not well planned.”

Soludo explained that the new laws are consequential to the Supreme Court judgment and not intended to undermine it.

“The new laws by Anambra House of Assembly are therefore consequential to give operational life to the Supreme Court judgment and not to undermine it,” Soludo stated. “If the State House of Assembly abdicates this constitutional duty, the Local Government will then have no law on the use and management of its finance.”

POLITICS NIGERIA reports that the bill requires local government areas (LGAs) to remit a portion of their federal allocations into a consolidated account controlled by the state.

Section 13(1) of the bill stipulates that the state shall maintain a “State Joint Local Government Account” into which all federal allocations to LGAs must be deposited. Section 14(3) of it mandates that each LGA must remit a state-determined percentage to the consolidated account within two working days of receiving their allocations.

Meanwhile, Section 14(4) outlines that if the state receives the LGA’s allocation on their behalf, it must deduct the specified percentage before disbursing the remaining funds to the LGA.

The truth of the matter is that if you want local government autonomy of whatever you call it,you have to change the constitution completely. Even the constitution says the LG is under the control of the state government.

Worldwide there is nowhere there is 3 federating units. It is always two. The Federal and state.

In a true federalism like it's practised in the US. The LG is under the control of the states. The US has over 80,000LG and states create LG as they wish.

Here in Nigeria,coupled with the fact that the money being given to the LG are not even enough to pay salaries and that is why the states created joint LG accounts to offset the bills of LG since 1999.

All states have been offsetting the bills of LG because even the money they collect isn't up to anything

Soludo is a great governor.

Today all the governors are using federal roads as excuses.......
The little effort been made on community road will be no more, because the state governors will now say it is for the LG chairmen and the chairmen will say it is the state governors job........so back to square one...

This is a brilliant move by the Anambra state House of Assembly and Governor Soludo. This is exactly what is needed to address the Supreme Court ruling on LG autonomy.

Local governments are supposed to directly connect to the people. Governors seem to have the fear that local government chairmen would become too financially powerful and usurp their authorities.

Hopefully the Federal house of Assembly will enact better laws to protect local government. Our constitution appears not working in that regard.

Soludo is in order. Supreme court erred.

the supreme Court judgment is not even in line with the Constitution. They should have amended the Constitution First.

Dude doesn't want to borrow money, invest in profitable ventures and pay back later. He wants to beat the title of a governor that didn't borrow money while taking that which belongs to the local government. It is well.

If you listened well to the professor he has his reasons but the problem here is that the next person coming after him might use the law against the local Governments. What Soludo will do the Local Government with the law is what Nigeria Federal Gov is doing to the states. The resources in the states are pulled by the Fed Gov, the Fed Gov then decides what each State will get as an allocation. Without regional autonomy there cannever be a full fledged Local Government autonomy

They don't even know that the state has a significant input added to whatever they will collect from the Federal Government to offset some financial burdens and obligations. Prof is a very smart man and whenever he acts I am always inquisitive about his action and trust me after his detailed explanation You will pat him on the back and ask him to ride on.

Soludo kept saying total LG autonomy will lead to chaos without explaining in details "how".

I put it to you, Soludo, "HOW will LG autonomy lead to chaos?"

Oga stop misleading people, America doesn't have over 80,000 LGA. In the US what is called LGA in Nigeria is called counties and they are over 3,000.

What offset are you talking about? The bill is about taking a certain percentage from the LG allocation. How does that help in offseting the bills of LG's?

Oh my God ..why should a Prof sign this kind of law..are we illiterates?if the state governors can look into how their states can generate revenues locally without minding what is coming from the federal allocation,they won't have all this problem with the meager amounts going to the local government..infact they will even be helping some local government with their Budget.The military really messed the Federation of Nigeria up and it's Republican nature..the way Nigeria is been run .. nothing Federating about it nor anything republican..if the federating units can't manage its resources,that's a unitary government system not federal,if 5% of a whole local government allocation can be given to a traditional Council be it Oba,Sultan,Obi anyname of those men who are not productive to the economy but marry more wives , young girls and throw parties for the rest of their lives,then we are not republican..why should part of my taxes be paid to someone who I owe no allegiance nor sovereign to ..my sovereignty is to Federal Republic of Nigeria.
If the law says "deduction from local government account base on what is determined by the state government"..that's clearly undermining the supreme court judgment...and I think the AGF should contest this law at the supreme court ASAP for clarification before other states starts using same system.

Also that scrupulous security vote..it's high time SERAP,FALANA AGF contest that thing which is no where in existence in Nigeria constitution in the law court ..take that away from the governors too.

Although am very much aware of the way those local government chairmen with held teachers salaries in the 90s , didn't pay salaries for months until state government took ovwr ..also primary health workers too..the foundation is just totally wrong tho.we are in a mess..

The Military government made mostly of northern guys should not av numbered local government in the constitution..its an abberation..they should av simply said a staye must have local governments ..how many they decide to have it's their headache..how the money will be shared among them.. their headache..but allocation from the federal purse meant for local government should not be spent by the state government. The state government can only administer /share the money among them .

The local government has its own legislative council too made of councillors..they make by laws Mr Soludo..make this thing work don't by pass it .
