President Tinubu departed for the United Kingdom on October 2, 2024, for a two-week working leave. He later left the UK for France on Friday, October 11, for “another important engagement,” his Senior Special Assistant on Political and Other Matters, Ibrahim Masari, tweeted. Meanwhile, Vice President Shettima left Abuja on Wednesday for Sweden on a two-day visit to represent Nigeria in bilateral engagements with the Scandinavian nation. This marks the second time both officers have been concurrently absent from the country since assuming office 17 months ago. Between late April and early May 2024, while Tinubu was in London, after visiting the Netherlands and Saudi Arabia, where he attended the World Economic Forum, Shettima left Nigeria, first to Nairobi to attend the International Development Association Heads of State Summit. What does the constitution say: Section 145 (1) and (2) of the Constitution of the Federal Republic of Nigeria, 1999 (as amended),which will subsequently be referred to as ‘the Constitution’, cited by him in aid of his defense of his principal. 145 (1) ‘’Whenever the President is proceeding on vacation or is otherwise unable to discharge the functions of his Office, he shall transmit a written declaration to the President of the Senate and the Speaker of the House of Representatives to that effect, and until he transmits to them a written declaration to the contrary, the Vice-President shall perform the functions of the President as Acting President.’’ Take note of this: According to the Cambridge English Dictionary, whenever means ‘’every or any time’’. The same dictionary also defines vacation as ‘’a time when someone does not go to work or school but is free to do what they want, such as travel or relax’’. Simply put, If the President want to leave Nigeria (his home) for another country, he must hand over to his Vice to take charge of his home until he returns. HE DOESN'T HAVE THE CONSTITUTIONAL POWERS TO GIVE ORDERS FROM ANOTHER COUNTRY REASON HE HAS TO HAND OVER TO HIS VICE, THERE WONT BE ANY NEED TO HAND OVER TO HIS VICE IF THE CONSTITUTION SAYS HE CAN RULE FROM ANOTHER COUNTRY. Similarly, Neither the President or his Vice can give orders wether virtually or otherwise from outside the country as Bayo Onanuga mischievously said in defense of the Presidency. Is it not a rascality that Vice President Shettima depart the country when he is fully aware the President is not around to discharge his duty? Does he even respect respect the constitution? Does Vice President Shettima think the job of the Presidency is a Work-From-Home or Virtual Assistant job?

How do we expect Nigeria to get fixed soon when both the President and his Vice are running away from their responsibility. If you cannot stand the heat, leave the kitchen. President Tinubu and Vice President Shettima should honorably resign and vacate Aso Rock if the Villa is too hot for them.

President Tinubu and the vice president have contravened the constitution governing this country and as such should be sanctioned and suspended from the office respectively.

The national assembly should, as a matter of urgency, initiate the impeachment process against President Tinubu for violating the constitution of the Federal Republic of Nigeria. |

Electorate:Here is the key word " unable to discharge his duty". Travelling out of the country doesn't mean he's "unable" to discharge his duty. Unable means being sick or incapacitated. It doesn't mean travelling out. |

Enice:What it actually means is that the President might not have travelled out of the country but he is unable to carry out his duties due to ill-health or other circumstances that renders him unable to do so. The constitution is therefore referring to two scenarios. |

Racoon:You just realized? Lawlessness had existed since 1967. The moment the aburi meeting was jeopardized, it set the motion for lawlessness: 1. writing constitution without legally acceptable procedure 2. Introducing another criminal code in disguise of sharia, contrary to the section of the constitution that upholds secularism 3. 3rd term bid that was twarted when Ararume ran away with the cash 4. Secrecy surrounding yaradua until a brave woman from the east spoke up 5. Extrajudicial killings by state actors 6. Media gagging 7. High level corruption in NNPC with presidents as the ministers etc |

Enice:Then what is the essence of HANDLING OVER to his Vice BEFORE traveling OUT of the country in GOOD HEALTH as the CONSTITUTION pointed out? English though not our mother tongue shouldn't be this difficult since it is a language taught in school from childhood...STOP DEFENDING RUBBISH, IT IS MORALLY BAD.

Electorate:Oga! I'm not defending rubbish! No one is talking about Tinubu being on vacation! You guys are the one making a mountain out of a mole hill. You don't have any proof to show if Tinubu handed over or not. The issue has been if the constitution allows both the vice president and president to be out of the country at the same time! What I'm saying is that yes, it allows them so long as one of them is active officially. |

| Re: It Is Constitutionally Wrong That The President And His Vice Both Leave Nigeria. by Enice(m): 1:57pm On Oct 19, 2024 |
Electorate:Go and read that section of the constitution again! The are two key words there. 1. Vacation 2. Unable to discharge his functions Now, the president is on vacation while the VP is not. Therefore the VP is assisting on behalf of the president. Is the VP unable to discharge his functions just because he travelled outside the country? The answer is no! Because if you say he's unable then it means whenever he goes outside Abuja, then he's unable to discharge his duty. |
