I'm sure Hebert already set up a trustfund for his parents while he was alive. How else were they been taken care of? You think he sends them money monthly or something? You still don't get it. Muslims are use the Qur'an to share their estate. But not all Muslims use it. Abiola didn't use it, did they?

So, issues do arise and it has nothing to do with the mode of sharing as you want to claim but with the individuals in question. Because why else will one hold on to the property of another despite the instructions of sharia?

Same way, in this vein, why else would you contest for properties when there's a legally backed will.
