I currently live in a state where defamation is listed under the criminal code as a misdemeanor same as in Nigeria— just like in Nigeria, defamation law here is written right in the Criminal Offences....Act. However, you don't dial 911 when you have or think you are being defamed. Rather, you are told to file a lawsuit against the one who you feel defamed you so the courts can upon reviewing your case decide whether it is a defamation case, whether the plaintiff should be compensated, or whether the defendant should be fined or serve jail time. An arrest can only be made in such cases if a misdemeanor warrant is issued by the courts. I doubt a policeman witnessing a defamation case of any kind has the right to arrest the defendant since a case needs to be filed in the courts for that to become a valid case, to begin with. undecided

Another interesting thing to note is that here in the U.S. there has been a push to decriminalize defamation since laws that criminalize it violate Freedom of Speech. Of course, Freedom of Speech does not give any the absolute right to harass other citizens, but civil lawsuits are fully capable of addressing the harm caused by defamation. And so the argument is that criminal defamation laws should have no place in a democracy. undecided

Good morning ma Nigeria and whatever country you stay in don't operate the same laws and you can't compel Nigerian Justice system to be inclined towards your perception of how the Law should be.

Also I once told you that through out the whole world laws are bent to fit certain people's needs, in other words, there are no such things as laws.
Even in the US, the "powers that be" can charge you with allegations based on anything and keep you behind the bars.

What I just described as the case in the state I live in here in the U.S. is the same as what takes place LEGALLY in Nigeria. Your laws in Nigeria stipulating when an arrest can or cannot be entered into attest to this fact —Section 38(1) of the Nigerians Police Act 2020 & Section 18(1) of the Administration of Criminal Justice Act.. Additionally, the fact that this Burna boy was somehow able to allow for the release of Speedy also suggests the courts were never informed of the arrest from the start— to drop a case in the courts does not happen that automagically—, a clear violation of the Nigeria Law. undecided
