2. That since he was working, that he wasn't in school. Is he trying to argue that those who are in school are not allowed by law to work?

Violating the terms of the visa doesn't make one illegal. Expiration of the visa makes one illegal. As in ... you entered with a student visa ... expiring in 2028 .... but never attended school ... you can conduct legal business ..using your passport ... stopped by the Police and present it ... you are still legal.... irrespective that you've violated the terms of the visa. After the expiry date ... it's a different story ... you wouldn't be able to conduct business and if stopped by the Police can be arrested and deported because you are now illegal. Violating the terms of the visa I guess can lead to revocation or a ban.
