Atiku is being mischievous here. That someone has filled appeal to a judgement doesn't mean that the lower Court Judgement hasn't taken effect, unless the Court grants stay of execution. Besides the money will not be seized and given to another State. It is still reserved for Rivers State. The aim is to protect the money from being spent without Lawful appropriation. If Fubara wins at the Supreme Court the money will be released to him. If he fails at the Supreme Court, he will have to do the right thing to gain access to the funds.

The infighting which started in 1967 from the old Rivers state. Some elders from the riverine areas against Igbos went to Kaduna and begged the then military governor of Northen Nigeria to plead with the then HoS, Yakubu Gowon, to separate non Igbo speaking groups in Eastern region from Biafra.
Gowon quickly created Rivers and Cross River states out from the old Eastern region.

Immediately after, Arewa soldiers and businesses men shared all the multi billion dollars oil Wells in the non Igbo speaking area of the old Eastern region.
The infighting goes on today in Rivers state.

Hate Wike and the 27 lawmakers all you want but on this issue, they are on the side of the law.

Answer these questions

1. The FHC via a judgement recognised them (Amaewhule and co) as the legit assembly. Has that judgement been vacated by a superior court?
2. Did the same judgement not state that the budget should be brought before Amaewhule over 10 months ago?
3. The COA ordered Fubara to present the same budget before Amaewhule and derecognized the 3-man Assembly. Did he obey?
4. Is Fubara not in gross violation of the constitution via à vis Sections 120 -122 of the CFRN 1999 as amended?
5. Did Fubara and his team not approach a court without jurisdiction (SHC) to vacate the seats of Amaewhule and co in gross violation of Section 272 (3) of the CFRN 1999 as amended?
6. Did the said State High Court not meddle in that matter? Was it not celebrated by his wing, including the AG of the State who is to know better?
7. Did Fubara appoint commissioners without due screening by the Amaewhule-led Assembly?

Law has absolutely nothing to do with emotions.
Fubara and his team will keep losing out because they are not operating in consonance with the law.

Guess what? If the Supreme Court goes ahead to recognise the Amaewhule-led Assembly, then he will be gone in a week. His actions are impeachable offences. He should pray that the Supreme Court acts in his favour.

Instead of wailing and abusing Wike and blackmailing the Judiciary, TAKE YOUR TIME AND STUDY THESE LEGAL PRINCIPLES ESTABLISHED IN OUR DIE GRUNDNORM.

Seek for a copy of the judgement and keep yourself intellectually afloat. No go dey argue empty.

Well with the influx of millions of dollars coming from the IMF and Worldbank , Abuja wont miss Rivers revenue. This is a worrying trend.

The question one is forced to ask is what's the point of generating revenue for an irresponsible government that wont allow you to access it.

The other states that are loafing on Rivers IGR need to ask themselves these questions too.

This can be argued from different angles.

1. I might be wrong, but I don't think Nigeria has ever experienced a situation where majority of the members allegedly defected including the speaker. Section 109 (2) holds that the Speaker shall declare the seat of such a person vacant.
Who then declared their seats vacant? Remember, Edison Ehie and 3 ors were already suspended. So could not have pulled such as suspended members.

2. Go to court and challenge the alleged defection. Is there a judgement today against Martins Amaewhule and co as the legit Assembly members? Instead, there is a fresh COA judgement recognising Amaewhule and co.

3. The law is that an affidavit containing statements that are "MANIFESTLY UNTRUE" will be discarded. If I depose to an affidavit stating that "I am now the Chief of Army Staff," does it make the the COAS? Amaewhule and co should them be charged with perjury because they were never members of APC and did not comply with Article 9 of the APC constitution that borders on membership which I will upload below for your perusal.

My brother, Section 109 IS NOT self-executory.
It should be fought up to the Supreme Court.

My happiness is that river state is about to take over all her resources back from federal government,all companies in Rivers will now pay tax directly to the state government or relocate.The gas station supplying gas from imo, rivers and other southern states will be cut off.You can't deny us the same food that we cook.River state and other Niger delta state is not what the government can play with.

Agreed! Fubara is being oppressed here but the law is not a respecter of persons. One man cannot hold the state to ransom! Let him respect the law. If it favours him fine and good, if it doesn't, let him take it that way.

That no Speaker was available to declare vacant the seats of Amaewhule and his codefectors does not mean that their seats still remain. It's like saying no authority declared an armed robber a thief, therefore the thief is no thief.
Amaewhule and co lost their seats according to the constitution of Nigeria.

Other people defected to APC, did their defections comply with Article 109 of the part?

I know they are greedy. But wike is too greedy. All his moves show this na. How can wike appoint all the commissioners and special assistants for a governor. It is not fair. Who does that? Even tinubu didn't do such in lagos.
