Can We Do Nikaah With Pregnancy? by Rashduct4luv(op):
Summary of Answer!
It is forbidden to tie the nuptial knot (Nikaah) while the bride is pregnant. The fornicator(s) should repent sincerely to Allah and the bride should wait for a menstrual cycle after giving birth! The correct position which is that of the majority of Muslim scholars is the forbiddance of the attribution of the kid born from fornication to the fornicating biological father! A child born this way will not inherit the biological father accordingly! Also forbidden is aborting the fetus as a result of the shame of fornication!

Preface:
This is common in many tribes in Nigeria and in many countries all over the world. The bride get pregnant before they think about solemnizing the union in Nikaah! And some Muslims are not left out in this backward culture as sometimes there exist an agreement between the dating partners to do the Nikaah when pregnancy is confirmed!

Firstly:
It is permissible for the one who committed zina (Illegal sex) to marry the woman with whom he committed zina if they are no longer regarded as zaani (Fornicators) , which is after repenting sincerely. If she is pregnant, it is not permissible to do the marriage contract with her until her pregnancy ends, and the child is not to be named after the zaani according to the majority of scholars. Some scholars are of the view that the illegitimate child is to be called after the zaani if he acknowledges him.

In Fataawa al-Lajnah al-Daa’imah it says: What is required of both of them is to repent to Allah then to give up this crime and regret what has happened in the past of committing immoral actions, and they should resolve never to go back to it and they should do a lot of righteous deeds in the hope that Allah will accept their repentance and turn their bad deeds into good deeds. Allah, may He be exalted, says (interpretation of the meaning):
“And those who invoke not any other ilaah (god) along with Allaah, nor kill such person as Allaah has forbidden, except for just cause, nor commit illegal sexual intercourse and whoever does this shall receive the punishment.

69. The torment will be doubled to him on the Day of Resurrection, and he will abide therein in disgrace;

70. Except those who repent and believe (in Islamic Monotheism), and do righteous deeds; for those, Allaah will change their sins into good deeds, and Allaah is Oft‑Forgiving, Most Merciful

71. And whosoever repents and does righteous good deeds; then verily, he repents towards Allaah with true repentance” [al-Furqaan 25:68-71]

If you want to marry her, you have to wait until it is established that she is not pregnant by waiting for one menstrual cycle before doing the marriage contract with her. If it turns out that she is pregnant, it is not permissible for you to do the marriage contract with her until after the pregnancy ends, in accordance with the words of the Prophet (blessings and peace of Allah be upon him) that a man should not irrigate the crop of another with his water.

Secondly:
It is not permissible to abort the foetus in order to get rid of the shame of zina.

How will the bride get pregnant?


The Prophet (blessings and peace of Allah be upon him) said: “No man should be alone with a woman unless there is a mahram with them.” Narrated by al-Bukhaari (1862) and Muslim (1341). And he (blessings and peace of Allah be upon him) said: “No man is alone with a woman but the Shaytaan is the third one present.” Narrated by al-Tirmidhi (1171) and classed as saheeh by al-Albaani in Saheeh al-Tirmidhi.

Allah says (interpretation of the meaning):
“And come not near to unlawful sex. Verily, it is a Fahishah (i.e. anything that transgresses its limits: a great sin, and an evil way that leads one to hell unless Allah Forgives him).” [al-Isra 17:32]

And the Prophet (peace and blessings of Allah be upon him) said: “No adulterer is a believer at the time when he is committing adultery” Narrated by al-Bukhari (2475) and Muslim (57).

And he (peace and blessings of Allah be upon him) said: “If a man commits zina, faith comes out of him and hovers over him like a cloud, then when he stops, faith returns to him.” (Narrated by Abu Dawud (4960) and al-Tirmidhi (2625); classed as sahih by al-Albani in Sahih Abi Dawud.)

I have to confess that this is a very good ruling

I never believed such a good ruling could come out of Islam

The problem though is that the ruling is not based on any hadith or quranic injunction but the biased opinion of the scholar whom for all we know might have impregnated a woman and gave this ruling to justify himself just as Muhammad gave a Quranic revelation to justify marrying his son's wife

There is an hadith where Muhammad had a pregnant woman stoned to death after she had birthed and weaned the child

This hadith conflicts with the above ruling

It is obvious that you Islamists are now forming your own religion totally different from what your prophet did and taught

None of them could have said the shahada as they lived before Muhammad, and the shahada involves declaring that Muhammad is the messenger of Allah, ergo none of them could be mussulmen, case closed.

Ustaz is very clear here. Both of them can marry but not when the bride is still heavy, nikkah can be done only when the bride has put to bed and they have to wait after one menstrual cycle of put to bed.

No Sir. Ilah is a Canaanaite mispronounced word. The root word is Eloha which got mispronounced to Ilah by travellers. It is Baal the Canaanites used to refer to as Eloha which the Hebrews also adopted as they feared calling God's given name which is "Yahweh"
Ilah or Baal had a wife known as Ashterah. The two gods are identified in the Bible. Note that Allah who became the chosen name for the quraysh idol which is Muhammad's tribe also had a wife according to Quraysh tradition and three daughters just like the Canaanite god Baal.
Lastly, the idol of Allah in the quraysh tribe had same figurine as the idol Baal in Canaanland. The Father of Baal is El in the Cananite god as well which is where Al in AIlah came from.
