This needs to be settled now because of 2025 budget, other states are already presenting their budget for 2025

Even Fubara lawyers knows that today judgement is not favourable to Fubara.

The Appeal court today agreed the Hon Marthins remains the Authentic speaker of the House.

The Appeal court also described the Oko Jumbo faction of the House as a forum and not Assembly members

The Apoeal agrees that Fubara can't spend money with budget approved or passed by the legitimate Hon Marthins House members.

The Three panels of the Appeal court who gave judgement, 2 agreed the FHC lacks jurisdiction to stop a state Allocation while one supported this. Thus the Appeal court Nullified the judgement of the FHC.

But see how ipob are rejoicing. Even Fubara and his camp are not happy with the judgement.

Here’s the full judgment

Court of Appeal Judgement today says
1. Rt. Hon. Martin Amaewhule is the Speaker and has the locus standi as the House of Assembly of Rivers State to institute the case against Governor Sim for spending without budget
2. ⁠The Judges in their judgement agreed completely with Justice Omotosho and their brother judges in the the Court of Appeal that Gov Sim is in gross violation of the Constitution by spending without budget.
3. ⁠The Judges were unanimous in their decision that 4 members who received the Appropriation Bill from Sim remain a forum and not the Assembly of Rivers State.
4. ⁠The judgement still says Sim cannot spend without a budget and does not have one.
5. ⁠On the issue of withholding of Allocation, the judges were divided. 2 out of three said the Federal High Court has no jurisdiction to stop allocation while the other judge disagreed.
6. ⁠In conclusion the Court of Appeal Judgement Favours Rt. Hon. Martin Chike Amaewhule and the 27 members. The judgement still agrees with Rt. Hon. Martin Amaewhule that Gov Sim is gross violation of the Constitution and cannot spend or continue to spend without an approved Budget from Rt. Hon. Martin Chike Amaewhule. Lawyers know the judgement is not good for Sim. The same court that says you can receive the allocation also says you can’t spend.

on a normal day, no judiciary would rule in favour of pro wike lawmakers unless it has been bought. Any small kata kata, any scheduled state assembly elections in Rivers State will be postponed. Fubara can decide not to conduct any election if he wants to play games with wike. But he needs to focus and not let Abuja becomes more conducive to business owners/investors in the state. that would be him winning the battle and loosing the war.

Ask yourself why the Governor is yet to issue a statement applauding the Appeal nullifying the seizure of Rivers state Allocation.

This judgement has put paid on the judiciary being accused of bias.

The rule of law has prevailed!

However, those singing hosanna today shouldn't castigate the judiciary when judgement doesn't go their way by heaping invectives on the judiciary.

In law, you win some and lose some based on the interpretation of the law.
