The Constitution specifically created the SLGJA and the SC is abrogating it. The SC has no such powers. You cannot use illegality to cure illegality. Illegality usually begets illegality. APGA made a law mandating LGs to return their allocations to the SLCJA in line with the constitution after that judgement. Lagos Assembly suspended a Chairman after the SC ruling. Now this.

I cannot remember for now but I know that the state assembly controls the administration of the local government council while the local government legislature are handicapped.

No Sir. That is not true. The state assembly have specific roles they are to play in LG administration but they do not oversee LGs as you think. They are to pass the budgets of LGs as well as determine the ratio for allocation of revenue to LGs. That's where their constitutional powers over LGs end. They have no business with what an LG chair does or not. You can see that the two cases of Lagos and Edo are hiding under financial malfeasance to sack the LG chairs because they know that is where they have power but their power is simply to approve the budgets of the LGs not to monitor or discipline LG chairs

Please can you bring out authentic news of him withholding their salary for three months. If he does, it was wrong but he never sacked them, which was what you raised in your initial comment. They exhausted their tenure in full.
My brother, tenure elongation is against the letters of our constitution. It was wrong for the Martin's led assembly to have gone against the law of the land by extending their constitution by 6 months after expiration. Their self made law was against the constitution and any law made that doesn't agree with the constitution, the constitution takes superiority. That's just the common law that even ordinary citizen should know.
Please which of the supreme court gave life to tenure elongation? I hope it is not our supreme court? No court will give life to tenure elongation in Nigeria, except it is a banana Republic nation.

The states usually just overreach themselves in a bid to take control of the grassroots. Meanwhile, I'm yet to hear Tinubu's attorney general say anything about this classic assault on the LG. Note they used the word suspended so that it looks as if they were not sacked. This will ensure they continue to get the allocation meant for the LGs and share it or keep it or whatever.

The state assembly to oversee to their discipline constitutionally when they breached the law or I simply put, when they commits gross misconduct. Please I am not trying to back the Edo assembly for what they did but I am just saying it loud, the lacuna that our constitution created but instead we are going through the backdoor to see they third tier of government works through the court without doing the right thing, tinkering with the constitution to reflect what we want for the third tier. Until that is done, the loopholes would be used greatly by the state apparatuses.
I hope you're aware that the counselors have no too much role to play in the administration of the local government administration? They cannot correct or discipline the local government chairman, the way it was stated for the National or State Assemblies.
We are in this muddled water because the national assembly have not rise up to the occasion and fine-tune the constitution.
I said it that time that going to supreme court to buy judgement for local government autonomy was a waste of time and resources, that it was better to go to national assembly to sponsor executive bill to tinker with the constitution to give full autonomy to the local government, as done for the state and FG but you know what, people were celebrating medioctity and backside judgement.

The Chairmaen should remain in their seat. The SHA do not possess such powers.
The Supreme Court verdict was very clear on Local Govt Autonomy.

Everybody will be keeping quiet now, later you will see the so-called learned IDIOTAS making rounds of media houses arguing how Farotimi criminally libeled Aare, meanwhile a law which the supreme court had clearly interpreted before they became SUPREME ICECREAM in the case of Oyo state vs their local government chairmen and other times, that neither the governors nor the house of assemblies have power to sack ELECTED LOCAL GOVERNMENT CHAIRMEN.
