Osun State Governor, Ademola Adeleke has directed immediate investigation on the case of one Segun Olowookere who was sentenced to death.

Olowookere was sentenced to death by hanging for theft of chicken.

Governor Adeleke gave this directive through a statement issued by his spokesperson, Olawale Rasheed on Tuesday.

The governor directed the state’s Attorney General to intervene in the matter and ensure the young man is listed for prerogative of mercy before the end of the year.

According to the statement, “I have read about the case. I recognize separation of powers in our democracy.

“In this particular case, I have directed the Commissioner for Justice to initiate processes to grant the prerogative of mercy to the young man.

“Osun is a land of justice and equity. We must ensure fairness and protection of the sanctity of lives.

“I assure the public that the matter is receiving my direct attention. A sense of urgency is also attached to our response to the matter as a responsible state government.”

The directive is coming after an appeal for clemency to the governor on behalf of Segun Olowookere by the World Institute of Peace.

In the appeal, the institute’s Executive Director, Lamina Kamiludeen Omotoyosi, revealed that Olowookere was sentenced to death 10 years ago when he was 17 years of age.

Omotoyosi said, “Segun’s conviction stems from an incident involving the allegation of theft of a fowl and eggs from a poultry farm in Oyan, Osun State over ten years ago.

“The gravity of a death sentence for such an offence raises significant ethical questions, particularly when considering the young age at which Segun was convicted and the minimal value of the items involved.

“However, no justification for any crime but Segun actually pleaded not guilty to this crime.

“His parents, Folashade and Olanrewaju Olowookere, have been vocal in their pleas for clemency, expressing their devastation over the loss of their only son to the confines of prison for over a decade.

“As you are aware, the principles of justice and mercy are foundational to a progressive society.

“The parents have made heartfelt appeals, emphasising that Segun is a brilliant young man with a promising future.


“They have endured immense suffering, selling their properties in an attempt to secure his release, and they continue to hope for a second chance for their son.

“The weight of the punishment far exceeds the nature of the crime, and it is clear that Segun’s case merits a compassionate review. Please, Mr. Governor.”

*The Facts of the Case*

Contrary to sensationalized reports, the conviction of Olowookere Segun and Morakinyo Sunday was not for the petty theft of a fowl, but for armed robbery and related crimes. The prosecution, led by the state Solicitor-General, Mrs. Abiola Adewemimo, presented irrefutable evidence, including eyewitness accounts and confessions from the accused.

The case stemmed from an incident in the year 2010, when the convicts forcefully broke into the home of Mr. Balogun Tope, a police officer, armed with a cutlass and a dane gun. They carted away valuables, including livestock, and were apprehended following their involvement in similar robberies. The evidence showed a clear pattern of criminal behaviour, including their admission to robbing another individual, Alhaja Umani Oyewo, from whom they stole broilers, eggs, and kegs of vegetable oil.

Justice Jide Falola of the Osun State High Court, sitting in Okuku, delivered a judgment grounded in the law. The convicts were found guilty of conspiracy, robbery, and stealing, with sentences proportionate to the gravity of their crimes, death by hanging for conspiracy, in accordance with Section 6(b) and 1(2)(a) of the Robbery and Firearm (Special Provisions) Act, Cap R 11, Laws of the Federation of Nigeria, 2004. Life imprisonment for robbery. Three years’ imprisonment for stealing.

The judge also showed humanity in his judgment, recommending that the governor may consider commuting the death sentence to a ten-year prison term, given the convicts’ ages and circumstances. This reflects a balanced application of the law, tempered with empathy, a situation we now witnessed been put into play by the Osun State government.

It is however disheartening to see attempts to trivialize this case by focusing solely on the theft of a fowl, ignoring the armed robbery charges and the overwhelming evidence presented in court. Such distortions risk misleading the public and eroding confidence in the judiciary. It is important for citizens to understand that the judiciary operates based on evidence and established legal frameworks, not emotion or public sentiment.

To those who care to know, the judiciary system in Nigeria cutting across the 36 sates and federal capital territory is a pillar of democracy, tasked with delivering justice impartially and without bias. So in the case of Osun State, Justice Falola’s handling of the case in question reflects the professionalism and integrity that underpin the judiciary's work. The prerogative of mercy, if exercised, is not a repudiation of the court's judgment but a constitutional tool for tempering justice with clemency.

Members of the public are urged to seek facts and reject narratives designed to undermine the judiciary. Trust in this institution is essential for maintaining law, order, and justice in society. The judge that presided over that case and passed that judgment should be sentenced to death.

As for the governor Adeleke, rather than use this as only a means to score cheap political point, you should be looking into the kind of laws or loopholes in the law that will give a judge that kind of power to sentence someone to death over theft of a chicken. Except there is more to this case than we are being told, the root is what we should be cutting not the leaves.

The name of the judge who sentenced a chicken thief to death should be made public. He has a personal axe to grind with either the boy, his parents, relatives or the whole community. It can never be about the chicken.

This is just one case out of many. We do not know how many people have lost their lives or are waiting to be executed because of miscarriage of justice in this country. Nigeria's judicial system has faced significant challenges with corruption, which has undermined public trust and the effective administration of justice. Issues such as judicial bribery, procurement fraud, and the misappropriation of public funds are prevalent. How does that judge sleep at night after delivering that harsh judgement on a 17 year old? I don't condone or support even the smallest theft, but for goodness sake that judgement was harsh. And it may surprise you, that this type of judge is the one that receives bribes to truncate justice. Meanwhile a big man will steal billions and go with his supporters and praise singers to court, knowing fully well that he will get a chicken feed penalty. But poor man will steal Maggi or sugar and get life sentence or death penalty

Same Osun state where a judge sentenced someone to life imprisonment for stealing a sitting governor’s phone.

Judges in that state need mental evaluation.

Our judges are hard on poor citizens while lenient/voiceless on the rich.
