The Nigerian Electricity Regulatory Commission has directed the transfer of the regulatory oversight of the electricity market in Ogun State to the Ogun State Electricity Regulatory Commission.

The directive, according to NERC, via its social media handle on Monday, owes to the state government’s compliance with the provisions of the Electricity Act 2023 (Amended).

The Act requires that for the establishment of any intra-state electricity markets, the state must notify the commission of the processes involved, after which the NERC can give its authorisation.

In compliance with the amended Constitution of the Federal Republic of Nigeria (CFRN) and the Electricity Act 2023 (Amended), the Nigerian Electricity Regulatory Commission (“NERC” or the “Commission”) has issued an order to transfer regulatory oversight of the electricity market in Ogun State from the Commission to the Ogun State Electricity Regulatory Commission (OGERC).

“Recall that with the EA 2023, the Commission retains the role as a central regulator with regulatory oversight on the inter-state/international generation, transmission, supply, trading and system operations.

“The EA also mandates any state that intends to establish and regulate intrastate electricity markets to deliver a formal notification of its processes and requests NERC to transfer regulatory authority over electricity operations in the state to the State Regulator.


“Based on this, the Government of Ogun State complied with the conditions precedent in the laws, duly notified NERC and requested for the transfer of regulatory oversight of the intrastate electricity market in Ogun State,” the statement partly read.

The transfer order by NERC states, “Direct Eko Electricity Distribution Company (EKEDP), Ikeja Electric PLC (IE) and Ibadan Electricity Distribution Company (IBEDC) to incorporate subsidiaries: EKEDP SubCo, IE SubCo and IBEDC SubCo respectively to assume responsibilities for intrastate supply and distribution of electricity in Ogun State from EKEDP, IE and IBEDC.

“EKEDP, IE and IBEDC shall complete the incorporation of EKEDP SubCo, IE SubCo and IBEDC SubCo within 60 days from December 24, 2024.

“The subcompanies shall apply for and obtain licences for the intrastate supply and distribution of electricity from OGERC, among other directives.”

The commission noted that all transfers envisaged by this order shall be completed by June 23, 2025.

But most people can't see it.

Even if Mr Tinubu only spends 4 years (no thanks to unjustified bitterness from some people from the South who are determined to foist another ineffective leader on this country), we will look back and thank him for the on-the-low restructuring that he is putting in place.

Local govt will now get their funds directly.

Each State can now generate and regulate electricity (Mr Buhari gets some credit here too)

Tax reform is coming.

State police is coming.

And I am sure he has more under his belt.

Only a strong, stubborn President from the South can do all these.

Yet, the same Southerners that have been shouting restructuring! restructuring! over the years are the ones now vowing they will vote another Northern president in 2027.

Just because of unnecessary hate for Mr Tinubu.

As far as the national grid madness is not unbundled, nothing much will change.

How can you generate electricity in Nigeria state and transmit it all the way to Enugu or Oshogbo?.....this is the major causes of grid collapse and a lot of energy losses experienced during the transmission and distribution is transferred to unmetered costumers on estimation

So many anomalies in Nigeria and unfortunately, the many of the people saddled with the responsibility don't even know the main problem

I did not just read and understand, I am an expert in the field so be humble and learn as I tried proferring solutions to the problems at hand
Transferring oversight function to the state electricity regulatory commission is good starting point but it is meaning and useless as far as the national grid madness stays.

See, even as a staunch critic of the current Administration, it costs me nothing to admit that a sound number of Tinubu's policies are good enough to occasion long-term benefits but one truth some of you still don't want to swallow is that the speed at which these policies were reeled out without the necessary measures to cushion their biting side-effects, has resulted in widespread anguish of the governed, and that's more than enough reasons for people to constantly vent.

It is not hate as you have casually termed it. There is no amount of political correctness that should blind anyone to the sufferings in the Nigerian streets and homes. To do that is to exhibit insensitivity and outright cruelty.

This is not entirely correct.

Under the Electricity Act that just got signed into law, States can independently "generate and distribute" electricity, should they have the wherewithal to do so.

At that point, nothing suppose concern states with National grid wey dey collapse like epileptic patient.

Under Mr Obasanjo, $12 billion was 'spent' on power, yet no tangible result.

Under Mr Jonathan, Nigeria made the most money since gaining independence. The man and his PDP people squandered and stole everything, including Mrs Deziani who ran away with over $2 billion. Next to nothing was invested in the grid.

So what magic can the current President perform.

States generating their own power may not solve the issues surrounding the national grid immediately, but over time with States like Lagos, Rivers, and other rich states generating and distributing their own power, hopefully through their own grid, the pressure on the national grid will start reducing.

Your points are made out of emotions and no logic....what was Nigeria power generating and transmission capacity before and after OBJ regime?....have you ever heard of NIPP projects under him?
How can GEJ that subsidized fuel, electricity, forex make more money than Tinubu that floated the naira and removed all subsidies yet left Nigeria with debt of over 130Trn?

Besides 18months is long enough to show clear policy directions and impacts felt, states that can fund the projects should merge with others or it can even be handled by geopolitical zones to make it faster and seamless

The short term solution is very simple, FG should build power plants in the regions without any or those with less capacity and unbundle the nation grip, them start with regional supply while states boast it up with upgrade and attracting investors
