Of course you cannot do this with the president's consent only, the department must first be sanctioned by the legislature and whoever will lead it must be approved. Are you aware that the department of Government Efficiency (DOGE) that is requesting the financial records is not recognised under US federal law?
To begin with, Elon or whoever is chairing DOGE has zero locus standi to initiate the case in the first instance. So, the judge's order is very very legal.
