Of course you cannot do this with the president's consent only, the department must first be sanctioned by the legislature and whoever will lead it must be approved. In addition, is Elon Musk an auditor? If yes, when did he become one? Because as far as I know, even before Tesla's earnings reports are released, they have to be audited by one of the Big 4 or 5 (of you consider BDO) accounting firms, talk less of a whole country that has one of the most effective regulations in the world. Or did Elon Musk think the U.S is Twitter - which has since lost over 60% of its value since he acquired it - where he can do as he pleases.

To begin with, Elon or whoever is chairing DOGE has zero locus standi to initiate the case in the first instance. So, the judge's order is very very legal.

Instead of creating a new department from scratch, which would require Congressional approval, Trump repurposed the USDS, which was already part of the Executive Office of the President. By renaming it to the US DOGE Service, he effectively made it part of the formal government structure without needing new legislation.

Secondly Trump used his executive authority to sign an order that not only renamed the service but also redefined its mandate to focus on "maximizing governmental efficiency and productivity." This executive action allowed him to bypass immediate legal hurdles related to establishing new governmental entities.

So you see DOGE only answers to the president.
A lawyer taking DOGE to court is trying to tell the Executive what to do. The legislature is different from the executive.

Thanks for this. But after reading about USDS, I find out that it's duty is to provide consultation services to federal agencies.. So, I think it is still a subordinate to several federal agencies and would lack any power to hold unto what it is demanding from the court. And lastly, I don't think this issue is about taking DOGE to court, it sounds more like spelling out the limits of its power.
