the case fugbara withdrew was instituted when amewuhle was still in PDP and sitting as speaker of the Rivers State assembly. It was just about the budget and earlier impeachment of amewuhle which prompted the governor to present the budget to the new speaker honourable Elue.
It has nothing to do with the defection to APC which is another matter entirely.

that is 2024 budget weh don already finish now court dismiss yesterday.
Amaewhule was fighting a lost battle, now the case of 2025 budget will come up again and before that one go reach supreme court, they may have passed 2026 budget.
A week to election, the case of their defection will come up and they will be sacked by federal high court, then a fresh election will happen with Fubara fully in charge.

There was no evidence that the honourable defected to APC and anyone that who argued that is doing that just to feel better. It's a self denial thing.

Though, Fubara will drag the case till the end of his tenure and nothing will happen. He's spending 4yrs as River state governor.

The Governor should allow the court makes its pronouncement on the matter? On what basis would their seats be declared vacant? There is no incontravertible evidence that they decamped. They didn't resign from PDP,they didn't take membership card of APC,they claimed they held the APC flag to solidarise with PBAT which is not impossible. Above all,the supreme court had ruled in the case of Diri v Lyon that it is only an affidavit that is gazetted that one can rely on,hence the affidavit deposed to by the lawmakers can't be used against them since it was not gazetted. This is my opinion
