Dear Travel Guru, I would like to seek your advice regarding a custody and travel matter concerning my daughter. My ex-wife recently had a court wedding with her new husband yesterday. This morning, she informed me that she listed our daughter under her name as a single mother on their marriage certificate and now intends to take full custody of her. She also mentioned wanting to change our daughter’s last name to match her new husband's and asked if I could be present for the passport capturing process. I am concerned about the possibility of her taking my daughter to the United States without my consent. What steps can I take to ensure that my parental rights are protected and to prevent any unforeseen complications in the future? I appreciate your guidance on this matter. |

I don't know how American family visas work but I will suggest you let the child go. If you look at what your child will gain from it, and how that can also help you in the future. Except you have the means to give her the life, don't fight it. However, you must request for open communication with her when she gets to the US. You should be able to call, see and speak to her from time to time. Let them promise you that at least. |

I think the important thing is to have and maintain a relationship with your child, not name IMO. Maybe US immigration require mother and child to have the same surname, I don't know. You can also consult a lawyer if you can. latiephwald: |

If the embassy will accept a birth certificate with your name written as the father of the child, then you only have to write a consent letter. And you must have your own copy of the birth certificate. There's a thread here for US k1 and spousal visa, search for it and ask the question there. You will get more responses. |
