To legally defect to a political party, each members would have to go to
their respective wards, get accepted by the chairmen and then gets registered
as new members and pay necessary fees.
After then is a defection legal.

Merely, dancing on video or attending a rally doesn't qualify as a legal defection.

How does one become a member of a party? There is a procedure
How does membership continue , lapse or cease again there are rules and procedure.

However, those lawmakers should be prosecuted independently for contempt but nobody has filed the case in court yet.

If we are to go by the above logic to positioned here, it is safe to say that a governor can be impeached by mere oral declaration in a plenary too.
Please let's not mix emotions and facts.

There are laid down rules and legal procedures as regards the issue of party membership. Mere open declaration in a plenary supported by court affidavit doesn't stop someone from being a member of state legislature
Secondly, it is only a competent court of law that can declare a seat vacant, not speaker of the house

This is the problem of you nothing head. If it has favoured Fubara, you will praise them. There is no law that said decampees will forfeit their position cos you wouldn't have seen politicians will elected position doing such. Fubara just allowed crisispreneurs to milk him. Several labour party house of Rep members has decamped to Apc why did they not leave their seat. You bitter region has pushed Fubara to his political grave due to nzogbu nzogbu ways of reasoning. The coming days will be interesting.

A decision taken at plenary is a proper evidence of defection,, that's in a country of course,,, not in a zoo.

It's clear in the constitution,, THE SPEAKER IS THE ONE WHO DECLARES A SEAT VACANT, NOT THE COURTS.

It is now left to the defector to approach the courts and argue that they had a valid reason for defection and get an order maintaining status quo.

If he succeeds he remains in the house until the case is exhausted...
