Here's my take:

I strongly believe that Governor Fubara's impeachment is inevitable. Despite claims that it's impossible without the Chief Judge's involvement, I think the law is clear: a governor can be impeached without the Chief Judge's participation, according to Section 188 of the 1999 Constitution of Nigeria [1]. The State House of Assembly has the power to investigate allegations and impeach the governor with a two-thirds majority vote.

Personally, I think Fubara's actions have been reckless, and his challenge to Wike's influence has sealed his fate. That section 188 subsection 5 states clearly the duty of a state Chief Judge during impeachment proceedings.

SO FUBARA SHOULD FIGHT HARD FOR THE PROTECTION OF HIS STATE CHIEF JUDGE BECAUSE IF HE LOOSES HIM, HE LOOSES THE SEAT.

Impeachment is when elected government officials such as the President, Vice-President, Governors, and Deputy Governors are lawfully removed from office before the end of the tenure of office if found guilty of gross misconduct.

The legislative arm of government in a nation is saddled with the responsibility of impeaching government executives who are found guilty of gross misconduct.

The process of impeaching a state governor in Nigeria is contained in Section 188 of the 1999 Constitution.

Under certain terms and conditions, a Governor may be replaced by another, for example through death, impeachment or if an election is annulled.

Here are the steps below:

Step 1: A written allegation of gross misconduct against the governor must be signed by at least one-third of the members of the State House of Assembly and presented to the Speaker of the State House of Assembly.

Step 2: Within seven days, the Speaker of the House of Assembly is expected to serve the state governor with a copy of the notice of allegation.

Step 3: The governor has a right to reply to the allegation levelled against him. The state lawmakers must be served each with the response from the governor.

Step 4: Within 14 days of the presentation of the notice to the Speaker of the House, they shall resolve by motion without any debate whether or not the allegation shall be investigated.

The motion must be passed by at least a two-thirds majority of all members of the State House of Assembly.

Step 5: If the motion fails to get two-thirds, the process shall be halted. If the required votes are met, then the Speaker shall within 7 days of the passing of the motion, request the Chief Judge of the State to appoint a Panel to investigate the allegations.

Members of the panel should not have a political affiliation

Step 6: Within three months, The panel is expected to report its findings to the State House of Assembly.

Gov. Fayose was illegally impeached in 2006. The SC nullified the so-called impeachment.

It said that the impeachment panel was illegal and so the outcome of the impeachment was a nullity, adding that the illegal Ekiti Acting Chief Judge who presided over the impeachment panel had been dismissed.

What will become the fate of RSHA if they proceed with any impeachment process without the State CJ setting up a panel and giving Gov. Sim Fubara and his deputy a chance to defend themselves?

Here's my take:

I strongly believe that Governor Fubara's impeachment is inevitable. Despite claims that it's impossible without the Chief Judge's involvement, I think the law is clear: a governor can be impeached without the Chief Judge's participation, according to Section 188 of the 1999 Constitution of Nigeria [1]. The State House of Assembly has the power to investigate allegations and impeach the governor with a two-thirds majority vote.

Personally, I think Fubara's actions have been reckless, and his challenge to Wike's influence has sealed his fate. With Wike regaining his voice and making noise, it's clear that Fubara's camp is on shaky ground. The petition by the House to the DSS against the Chief Judge for age falsification is just another indication that Fubara's time is running out.

In my opinion, Fubara's fate is all but sealed. I predict that the Chief Judge's potential arrest and detention by the DSS, followed by the House of Assembly's investigation and impeachment, will be the final nail in the coffin. And if Fubara tries to cause violence or disrupt the peace, I have no doubt he'll be arrested immediately. Tinubu's influence will likely come into play, and Fubara's chances of survival are slim to none.

As someone who's watched Nigerian politics closely, I can attest that alliances are fleeting, and loyalty is a luxury few can afford. Fubara's situation is a perfect example of this. In my view, it's only a matter of time before he's impeached.

I could see that you are all quoting Nigeria constitution as if it is something important. Even the Lawyers and Judges always argue about most what is written in it. It is full of garbage.
