What the law says is that after the SoE has been GAZETTED ! Now how do you gazette an action without making an announcement! What is needed from the NASS is to pass a resolution. And as we all know, resolutions are not binding on the executive. They can accept or reject it.

According the to the Nigerian constitution. A declaration of a state of emergency ceases to exist if after 2 days (with house in session) or 10 days, there is no resolution by 2/3 of the house backing the state of emergency.

So yes, the resolution is necessary for it to stand beyond tomorrow.
