It is rather unfortunate that Dr. Reuben Abati asked that President Bola Tinubu be impeached by the National Assembly for declaring a State of Emergency in Rivers State. That same National Assembly gave the President the power to suspend a Governor via the Emergency Powers (Repeal and Re-enactment) Bill of 2018.

However, it is possible that people like Dr. Reuben Abati are either unaware of that law, perhaps think it is unconstitutional, or even have a different interpretation of the law, which is understandable and acceptable. In that situation, what a prudent man should say is that the suspended Governor and members of the suspended House of Assembly should go to court to seek a judicial interpretation of the law.

Also, Dr. Reuben Abati misinformed his viewers by calling President Tinubu a "dictator" for giving the administrator powers to make laws. President Tinubu did not say that the Administrator would make laws for Rivers State under the supervision of the Federal Executive Council. In fact, the President was clear that "The Administrator will not make any new laws."

The President said, "He will, however, be free to formulate regulations as may be found necessary to do his job, but such regulations will need to be considered and approved by the Federal Executive Council and promulgated by the President for the state."

It would be very sad for Nigeria's educational system if a PhD holder like Dr. Abati does not know the difference between a regulation and a law.

A law sets the legal framework for the government, while regulations provide the detailed rules necessary for compliance with the law.

In any case, using the platform of a cable news station to call for the impeachment of the President and Commander-in-Chief of the Armed Forces based on a limited understanding of the law and to misinform your viewers is rather callous and could trigger further instability.

It's stupidity to think the president declared state of emergency without the input of the NA.

Reno Omockery should also tell us when that draconian bill was signed into law for President Tinubu to hold on to it to suspend Rivers State Governor via mere declaration without National Assembly's 2/3 votes?

What Tinubu did is unconstitutional but Nigeria of today doesn't have National Assembly to checkmate the excesses of the President, so the only way out is people revolt.

Sheuns:

From a previous post

The argument on whether Buhari actually signed this bill and if it is actually a law in Nigeria is actually interesting.

However, even if this bill was not signed by Buhari and the legislature did not do the necessary thing to make it law, the fact that this bill was made to repeal a previous Law in this country shows that the President can actually rely on the older law to suspend the Governor as long as the courts have not declared that older law unconstitutional.

How a Falana does not know this is astonishing, and again my opinion that bias affects the minds of some people we should be looking up to for advice holds more water.

Re: Omokri To Abati: Your Phd Is A Bad Reflection On Nigeria's Education Sector by Obiedun(m): 5:05pm On Mar 19, 2025
Obi has a mob to please and because I understand this, I don’t take his utterances serious. He is a man who closes his eyes and ears to any unpleasant happenings in the South East but usually among the first to blow the trumpet if it happens in other geopolitical zone.

But Atiku.

This is man who was a vice president under PDP.

Yes, Namadi Sambo was also a vice president but he never nursed the ambition to be president which Atiku does every menstrual period.

He is therefore bound to provide leadership for the party.

Now, he is accusing the president of being undemocratic by imposing a state of emergency on Rivers state but no one has asked him what steps did he take to ensure that the crisis was resolved.

Tinubu is in APC yet he called the PDP man in Rivers state to a round table and tried to resolve the crisis in a way that would have made both warring parties do a give and take but Atiku did nothing for the state to witness peaceful governance.

He even poured fuel to the fire by openly applauding Sim any time he violated the laws of the land with his actions. He was hailing him to continue with his surugede dance, beating to his ears the drum of war and foolishness and self destruct.

That’s a supposed elder statesman.

When Sim got back home and said that the president’s timely intervention was unconstitutional, what did Atiku say?

Now, this same man is blaming the president for being proactive by declaring a state of emergency in a state where the supreme court had ruled that at it stood, there was no government in Rivers state.
