state where it talks about suspension of governor and state house of assembly
During a State of Emergency (SoE) in Nigeria, the President can take over the administration of the affected state, but cannot directly suspend the state government.

Section 305(4) of the Nigerian Constitution states that during a state of emergency, the President can issue directives to be executed by the Governor of the affected state, or in exceptional circumstances, the President can take over the administration of the state.

However, Section 305(5) states that the President cannot dissolve the state government or the House of Assembly, as this would be a violation of the principles of federalism and the separation of powers.

exactly what we are saying. Declaring state of emergency doesn't equate to suspending the state governor

support it with session(s) of d constitution
there is no section (not session) in the constitution that gives tinubu the powers to suspend a sitting governor or the parliament of a state.

PDP needs to calm down so they don't create chaos in Rivers State. The man who controls the military has the final say in this matter.

It's even too bad that the judiciary is no longer independent, meaning that the PDP will lose if they drag him to any court (even the Supreme Court).
where in the constitution does it state that "The man who controls the military has the final say in this matter"?

how has what you said negated what I said?

meanwhile, this is Section 305(4): The Governor of a State may, with the sanction of a resolution supported by two-thirds majority of the House of Assembly, request the President to issue a Proclamation of a state of emergency in the State when there is in existence within the State any of the situations specified in subsection (3) (c), (d) and (e) of this section and such situation does not extend beyond the boundaries of the State.

“The body language of the Jonathan administration leads any keen watcher of events with unmistakable conclusion of the existence of a surreptitious but barely disguised intention to muzzle the elected governments of these states for what is clearly a display of unpardonable mediocrity and diabolic partisanship geared towards 2015. Borno and Yobe states have been literally under armies of occupation with the attendant excruciating hardship experienced daily by the indigenes and residents of these areas. This government now wants to use the excuse of the security challenges faced by the Governors to remove them from the states considered hostile to the 2015 PDP/Jonathan project.

“The present scenario playing out in the country reminds one of the classical cases of a mediocre craftsman who continually blames the tools of his trade for his serial failure but refuses to look at his pitiable state with a view to adjusting,” he said.

“It has become crystal clear, even to the most incurable optimist, that the country is adrift. That the ship of the Nigerian state is rudderless is clearly evident in the consistent and continual attacks ferociously executed by elements often referred to as the insurgents in some northern states of the federation, particularly Borno and Yobe states respectively. Indeed, no part of the country is immune from the virulent but easy attacks, veritable indices of a failing state. No Governor of a state in Nigeria is indeed the Chief Security Officer. Putting the blame on the Governors, who have been effectively emasculated, for the abysmal performance of the government at the centre which controls all these security agencies, smacks of ignorance and mischief.”

“This Government, through acts of omission and commission, has fallen far short of expectation. It actively encourages schisms and all manner of divisive tendencies for parochial expediency. Ethnicity and religion become handy weapons of domination. Things have never been this bad.”

Why do Nigerian politicians enjoy making vacuous statements?

What does "Fubara remains Rivers State governor" mean? Can he exercise any of the powers of River State governor at the moment?

Can he step into government house? Can he access the State's accounts? NO!!! So what state governor is hehuh

This statement is like those empty nonsense people say at funeral's to make themselves feel good. You hear crap like "he lives in our hearts"! No he doesn't! He is freaking dead and gone, never to be seen again.

There are 2 options open to Fubara - one is to brief his lawyers to open up a case to challenge his suspension in court OR accept his suspension in good faith and use the 6 months to create channels of rapprochement with the law makers and the Presidency.

2. the question I asked you is how does all you said in your previous post negate the following?

there is no section (not session) in the constitution that gives tinubu the powers to suspend a sitting governor or the parliament of a state.

Who is a sitting governor?
A sitting governor with 4- men, wannabes?
Was it same situation in Borno or plateau State?
-So they all pulled down the State Houses of Assembly - with the Caterpillars.
-Or and they all operated 2- arms of government, instead of 3- arms
-Or and they all appropriate the Budgets, etc - with only 4- men out of 31 Legislatures .

At certain time in Nigeria's history, a certain president will suspend the governo of lagos state and put a man from Jigawa because some Agboro group are fighting in lagos. It might take time but it will surely come to pass. Let's calm down and watch

A Governor that quickly picked race out of the government house with his family immediately he overheard that the President is about to declare the state of emergency. I think he would have been ignored if not for his complicity in the blowing of pipelines up and down Rivers State. He is a master minder of the destruction of those pipelines because he said it himself that he would call the youth and tell them when to act and infact he would lead them also..... militant governor of Rivers State...
