This is common sense.

The last supreme Court rulings has capped whatever decision any other lower court would make.

No judge at either the State or Federal level would make any pronouncement that is at variance with the SC rulings.

That's how it works.
I think this is so wrong from the Judge but I wouldn't blame him but the Apex Court that delved into a matter that wasn't before them.

I repeat again, a panel of 5 cannot overthrow a judgement of the full panel of the Supreme Court.

They just flooded the courts with useless cases. The people misleading Fubara. Even that lawyer for LP urging the Federal High Court to proceed with the case ought to be sanctioned.

Now for you to defect you need to resign your membership at Ward level, after that then you can claim you have defected.
EL-Rufai is still an APC member because he's still a card carrying member, if at the Court they are still Card Carrying Member of PDP at ward level then NO CASE.
Take valentine of Anambra as case study, He resigned from the Ward he registered and then proceeded to register as an APC member at the Ward Level but Presented at the Federal Level.

Labour Party counsel, Clifford Chukwu, however, argued that the issue of defection remained a “collateral matter” and urged the court to proceed with the case, referencing the body of evidence already before it.

Clifford Chukwu must be a product of Imo state University or Abia state University. With that kind of hostel there, I don't expect him to reason normal. Imagine, he want the lower court to revisit a case already concluded by apex court

Even if there was a defection, the Supreme Court has said neither d gov or even the courts can pronounce d seats of defecting lawmakers vacant. Only d Speaker has that power and if u read d relevant section of the constitution it actually says the Speaker shall give life to the provisions of that section. That tells u it's a political issue, not a legal issue and thus as long as a speaker is ok with ur defection, u are good to go. Recall that d likes of Saraki, Dino Melaye, Eyinaya Abaribe, and of recent Ned Nwoko all defected and they didn't lose their seats

And the law says it is a MUST.

Where the speaker declines and fails to declare the seat vacant, then the court must come in.

Any aggrieved fellow house member or the political party which lost the members can go to court to force the implementation of the declaration.

It's so simple,, it doesn't even need a lawyer to explain this.


In the case of Rivers, somehow, someway, rightly or wrongly Edison Ehie found himself as speaker backed by a competent Rivers high court.

He was the one who declared the seats of the 27 vacant.

All those names you mentioned didn't lose their seats because no one was really interested in following them up...


With a fair judiciary, there is no way on earth that someone who leaves their party that sponsored them to the Legislature without any division at the NATIONAL LEVEL of their party would not lose their seats.

Obaseki did it in Edo when 9 became greater than 14, he succeeded for a while cos of d ghost president we had in Buhari but karma is catching him today politically in Edo and I doubt he can walk d streets of Benin even with armed guards. He is practically a certified "oghion oba" to d reverred Benin palace. Edison was never Speaker in Rivers, pls let's just rest that

Wike did it a lot during his 8 year reign. He used Rivers courts to frustrate Rivers APC and Amaechi.

Amaechi could barely take a stroll on the streets without a Rivers High Court ordering him to go back and maintain status quo.

Even if a mad judge gives a ruling you must obey it and then proceed on appeal.

A Rivers High Court recognized Edison as speaker,,
And so for that period he was legally a speaker.

You know this is the truth.
