Some property developers are notorious for obtaining official building approvals BUT then go ahead to alter the approved building design and structures.

The article CLEARLY emphasizes on the FACT that the tall overhead tank in the ATTACHED picture right BELOW fell from the hotel premises right into the late Chief Gani Fawehinmi's own presmises on 3 different occasions.


That's a total sign of a lack of due diligence in properly fixing the large overhead tank which could have easily led to the instant crushing to death of ANYBODY standing within Chief Gani Fawehinmi's premises, because as we can CLEARLY see in the ATTACHED photograph right BELOW, the hotel building is so close to wall of Gani's premises like the Senior Advocates have rightly stated and there SHOULD have been a setback of some meters.

The Lagos State Ministry of Land and Housing) which has oversight functions over building constructions in Lagos State. Period.

That location is a prime area within the Ikeja GRA. There is no way the developer would not have obtained the full necessary permit, including CofO to put up that edifice. He must have paid all the necessary fees and approvals. The only exception is building what was not approved. If I were the lawyers, I would check if what the developer built was consistent with the approved plan. If not, they have grounds to take legal action. The building permit could even be revoked on that basis alone. People in Nigeria are fond of altering building plans and make modifications after obtaining permits.

Proper town planning will not approve hotel, churches , factories in residential area,but in Nigeria anything goes.

Make una gather money buy the property from the owner, then destroy am, silly sets why didn't you purchase before the property before now?since you want serene environment around Fawhimi property, and the bitter truth is that you guys has publicly announce the fawhimi family house to the public, even that small privacy they use to enjoy is gone for ever, except they moved out.
Last last with all his effort, this is still the Nigeria we are living, long and short story, his best was not even enough, make una allow am rest. grin grin

Your understanding of this matter depends on background A LOT!

The hotel is built too close to the fence of its neighbour which is not good for safety and privacy purpose.


There should be a set back from the building to the fence of about 3 or 6 metres . Standard rule.



You are building a hotel and you are contravening the Law just because you are a Money Miss Roadhuh??


When we say Nigeria is lawless and you defend this or any lawless behaviour, we are the lawless ones.





If there is a fire in one of the rooms where is the space for the person caught in the room to jump down?



How will the Fire Service come in and do the needful?


The Hotel is built too close to the Fence which is dangerous for them and their neighbour.

Emotions aside, has town planning laws been contravened? if so, it is likely that building will sanctioned. If I remember right, there is a stipulated distance between a structure and the fence which must be followed.

“A 1000-litre capacity water tank installed right on top of this 4-storey structure has thrice collapsed and fallen into Chief Gani Fawehinmi’s compound from this same apartment. And this is in expensive GRA Ikeja o huh

Renting, living or owning a house in Nigeria is fast becoming another addition to the growing list of ways to meet an untimely death. Thats how a water tank hoisted high above in a compound in xxxx on top probably rusted or sub-standatd supports collapsed a few weeks ago and killed a lady who was busy sleeping in her room when the errant and poorly secured water tanker came crashing down on to her as sle lay asleep in bed.

God help us all in this our Nigeria.

Rogue landlords and property agents everywhere. That's how Femi Fourscore's apartment under construction in Ikoyi collapsed and killed a lot of people including the property developer a few years ago due to rushed work and building more floors than they had approval for in a quest to cash out with the sale of dollarised apartments that were over-subscribed and paid for in advance of construction in dollars.

Me don make up my mind sha that if i must to buy a house in Nigeria, it must be one that was constructed not later than 1978 (47 years ago) because at that time there was a bit of sanity in Nigeria as builders and developers dey fear military regimes at that time.

So in light of this, why are SANS arguing against the builder when the proper approval was obtained? You just put the onus on the government so why go to court against the builder? Does that make any sense?
